First amendment right – she can ask and you can say no and there is nothing she can do. She cannot refuse you service or ask you to leave the establishment.
Under the American Disability Act – you can say that you have a health issue that prevents you from wearing one. Once that is established and he/ presses the subject further you can report them. The first fine for any business is $75,000.00 any other complaints after that is $150,000.00
Today I was the only person in a big box store with about 200 people there during my two hours of shopping without mask.
Two employees came up to me and ask if I had a mask – I simply said I’m unable to wear one due to health reasons, they walked away.
Under the disability situation you may be right. They cannot discriminate.
However, your rights to do as you please end as soon as you enter someone else’s private property. They can make whatever conditions they like if you are on their property. Ever see the “no smoking” or “no shirt, no shoes, no service” signs? Same applies to mask wearing as long as you have no medical condition. And, even then, they can refuse you entry by offering curb service.
Private property rights are the foundation of the republic.
First amendment? How’s that even applicable to this situation?
The first amendment applies to the Federal government infringing on your rights not some store owner making rules on how you act in his store.
