As of today, people can no longer legal purchase under the new laws taking effect, due to the 10-day waiting period law already in place.

Gun sales in California have skyrocketed during the second half of 2016 after California Gov. Jerry Brown, a Democrat, signed into law earlier this year a sweeping new set of gun control laws that are set to take effect Jan. 1.
Brown signed into law six measures, including one that requires California citizens to allow the government to confiscate their “high capacity” magazines, a law that requires a background check for ammunition sales, in addition to a “bullet button law.”
So-called bullet buttons are devices on semi-automatic rifles that allow a user to easily eject and insert a new magazine. You will still be able to own rifles that have a bullet button in California, but you’ll no longer be able to purchase a firearm that has one, according to the Los Angeles Times.
However, citizens who own firearms with the “bullet button” will have one year to register the gun with the state of California as an “assault weapon.”

Brown signed that bill, the first 30 days in July were just insane. It died down for a while but now we are back with everyone trying to get what they can before the end of the year.”

If I could prove that 2 people stole and used a debit cards info and account info and conspired together and made a purchase can I sue 1: the bank employee who stole the account info and probably added overdraft protection to make it work ad 2: A UPS driver who scanned the package as delivered to the desk of a mailroom that had been closed for 1.5 hours and forged the delivery signature. I already went through the bank fraud dept of the bank and the morons did a shitty job and closed it and said I was responsible. It took me 2 hours of calls to get the facts and proof of this. They told me to file a police report and I am going to. Geeezus a 5 year old could have done a better investigation than the bank morons. The driver is 100% busted and I will discover how so much was charged to an account with NO overdaft protection and how the delivery address was the same as the billing address (mailroom).

Take your INFO to your local Law enforcement agency. Get a case started. The Sates attorney will be your attorney until the problem is solved or the case is closed. Then after the case is closed then get a Civil Attorney to Sue. You can use the info from the States Attorney in your Civil case.

Genius, just FYI, suing a person is completely outside the realm of the criminal arena. Suing is entirely in the “civil” area of the matter. Additionally, if one sues and then collects something from the criminal, you risk comprising the criminal investigation due to having reached a civil compromise in the matter. I’d hold off on suing if you plan on pursuing the matter criminally. Often at the end of a successful criminal investigation resulting in a conviction, the judge will order restitution be paid by the defendant. Hope this helps.
Thanks but I don’t care that much about sueing the individuals (they will be criminally prosecuted) I want satisfaction from the bank that has done nothing but jerk me around and has criminal employees. I’m sure UPS has gps on the trucks and it should show that the driver was no where near the said delivery place of the closed for over an hour mailroom that was supposedly left on the desk of a locked building at the time scanned and the owner NEVER signs for anything in the recipients name anyway. The owner is 100% on my side and an old friend and is going to help me all the way. The driver is busted and now I am making the case that an insider from the bank is a co conspirator. The charge was for over 800 bux and I had at most 200 in my account. I wasn’t aware of it for a while because I bought stuff after the overdraft (maybe 6 things) and they all went through. HOW is that possible? An insider put overdraft protection on my account (I have never had) and the ups driver KNEW the billing address was a maildrop. UPS has electronic signature record and that will also prove to be forgery. So to sum it up… conspiracy to commit fraud, fraud, bank fraud, forgery, and whatever else applies.
Most likely a husband/wife or girlfriend team. Bank employee and ups driver pair. Should be an easy case even for the mayberry detectives. It was a bunch of kids clothes that were purchased so all you have to do is find out what age and sex the clothes were for and what kids the suspects have and walla. Genius, let me offer some advice since I was once a defendant in a lawsuit. In my civil case, my lawyer screwed my case royally. I lost and still had to pay the bastard his legal fees in addition to paying the ape that sued me. It took me 3 years of working 2 jobs to pay off that shit. Be extremely careful in shopping for a lawyer. There are allegedly, and I say this tongue in cheek, some good lawyers out there along with shysters. I had a shyster. To this day I won’t talk to any lawyer about anything. The experience left that kind of taste in my mouth. Good luck cause you’ll need all you can get.

There are a statute of limitations on crimes (except murder) and civil law suits. For civil suits the time to file is usually within one year.
All people’s memories are less clear with each new day. Memories fade. The court knows this. Make copies of these posts you just made. Your mind is clear and the facts are vivid in your mind. Go ahead and write up an official statement for the court. Put the title at the top: Statement by Genius xxx, and the date. Keep it in a folder along with whatever papers are pertinent.

Once you initiate the criminal case, take a record of the police report to your bank and renew your attempt to get the charge rescinded.
I expect you’ll have better luck with the management once a bank employee name is on a police report.
Then look at your civil action. Small Claims court may be good for the restitution from the defendants. If you want more than that, get an attorney.
The first is a criminal case, Yes, call the police and file a report, it should be classified as Identity Theft. Larger bank crimes call the FBI. Once you have your report filed, then hire an Atty and sue for your claim. And btw/ thats why you never use your ATM card for anything but taking money out of your own bank ATM machine. Never use your deti card for purchases especially online. Use a credit card for purchase, because if it is hacked, the thieves are stealing Visa or MC’s money and not yours. If your debit card is hacked they can drain your entire bank account balance and also cause NSF fee to accrue if you wrote check again the balance, you thought you had in the account. That’s why people with no credit can’t get credit cards with better protection and they get screwed when they use their ATM Debit cards for purchses. Cant fix stupid.
Second- Did you get your package? If Not, then File a claim with UPS, and try to get the employee fired. Report that the UPS employee forged the signature. Most likely if you got your package, you are beating a dead horse, complaining to anyone. Check to make sure upon delivery a signature was required. The employee did not follow UPS rules and should be beaten with stick, which you can do next time you see them. lol

Hell yeah call the cops file a report and also get the FBI involved, The COPS won’t do shit for you, they are dumb and under staffed. However the FBI, surely will, and they can dig way deeper into this case with computer forensics to see how many more victims there were, besides just your case. I personally got politically involved in the late 80s / 1990 fighting NJ S-166 the Semi Auto ban. NJ is unfortunately a political suburb of NYC and to a lesser extent Philadelphia and while the Second Amendment advocates are second to none in their organization and zeal the demographics are overwhelming. Sarge, yes it will be on. I used to belong to the NRA but became very disappointed in their constant plea deals. I found GOA and was very happy with them. If you want a better dog to help guard your rights I recommend GOA . org I also used to go around at work trying to collect funds for judicial watch and GOA but the results were dismal. We have a small group but a good group and remote, I hope it’s enough…

That gave the pragmatic “accommodating” NRA time to work the politics. A decade later the political climate changed and the law expired. That’s working the system. The Second Amendment was given to the People, like all the other rights in the Bill or Rights. This was confirmed by the SCOTUS in the DC vs Heller decision, where they stated that the “People” in the Second Amendment were the same “People” that are mentioned in the First and Fourth Amendment.
The 2nd Amendment clearly guarantees the “right of the PEOPLE to keep and bear arms”, and certainly not “the Militia”.
Why would “the Militia”, a type of army manned by citizen-soldiers as opposed to full-time “regulars”, need a constitutional amendment to guarantee they have the right “to keep and bear arms”?
Is there any specific statement anywhere in the Constitution that the army Congress is empowered to raise has the “right to keep and bear arms”?
Of course not.
That is assumed.
It is implicit in the nature of all kinds of armies —- be they militia or regulars, volunteer, conscripted, or mercenary — to be armed.
They are all “armed forces”.
They all “bear arms”.
They all carry guns.
That is what they do.
It certainly no more requires an amendment to the Constitution to state that “the Militia” has the RKBA , than a specific statement that the army Congress is empowered to raise may be manned by armed troops.

People confuse the Second Amendment with the powers of the sovereign states. The Second Amendment was adopted in the Constitution to prevent the Federal government, an agent of the sovereign states, from creating laws to restrict citizens from owning/using weapons. It has nothing to do with states regulating arms. At the time of adoption, the state governments would have never considered restricting gun ownership. However, ultimately, the states as the sovereigns have the power to restrict/control anything that their voters will let them get away with, including guns. The only choice for the unhappy citizen is to vote with their feet and move to another more friendly state. So, California can restrict gun ownership in any way that they choose. It comes down to either the voters or the 3 percenters to change that.
They pass unreasonable guns laws so law abiding gun owners move, creating the illusion they have to import workers to fill jobs. Then CA will have more democrats and can pass more anti-gun laws while milking the population for whatever money they might still have left.
