An Arizona man who has waged a 10-year campaign to stop a flood of illegal immigrants from crossing his property is being sued by 16 Mexican nationals who accuse him of conspiring to violate their civil rights when he stopped them at gunpoint on his ranch on the U.S.-Mexico border.
Roger Barnett, 64, began rounding up illegal immigrants in 1998 and turning them over to the U.S. Border Patrol, he said, after they destroyed his property, killed his calves and broke into his home.
His Cross Rail Ranch near Douglas, Ariz., is known by federal and county law enforcement authorities as “the avenue of choice” for immigrants seeking to enter the United States illegally.
Trial continues Monday in the federal lawsuit, which seeks $32 million in actual and punitive damages for civil rights violations, the infliction of emotional distress and other crimes. Also named are Mr. Barnett’s wife, Barbara, his brother, Donald, and Larry Dever, sheriff in Cochise County, Ariz., where the Barnetts live. The civil trial is expected to continue until Friday.
The lawsuit is based on a March 7, 2004, incident in a dry wash on the 22,000-acre ranch, when he approached a group of illegal immigrants while carrying a gun and accompanied by a large dog.
Attorneys for the immigrants – five women and 11 men who were trying to cross illegally into the United States – have accused Mr. Barnett of holding the group captive at gunpoint, threatening to turn his dog loose on them and saying he would shoot anyone who tried to escape.

We all know the answer, a resounding, NO!
Today we are committed to a worldwide struggle to promote and protect the rights of all who wish to be free. In a time of domestic crisis men of good will and generosity should be able to unite regardless of party or politics and do what is right, not what is just popular with the majority. Some men comprehend discrimination by never have experiencing it in their lives, but the majority will only understand after it happens to them.

The issue is so simple – they are not immigrants; they are ILLEGALS. This is not a human rights or racism issue. It’s very basic. I have nothing against immigrants – welcome, my fellow Americans. When you cross the border by stealth illegally (notice that word) you have broken the law and become a criminal; just like you would be if your crossed illegally into Mexico. Period. Crossing illegally into a country (making you a criminal) and subsequently trespassing on private property, is a dangerous thing to do. That rancher could have chosen a different course of action. People who so vainly use those illegals to add a humanitarian tone to their political agenda, do them a great disservice.  If you really care about them, encourage them to go home, become actual immigrants (not criminals), and enter the country legally.

Despite that unfortunate sentence, he conducted his life as if he believed that different human subspecies are distinct and unequal. It’s unlikely that he meant to say that every denizen of every third world cesspit (e.g., Mexico) on the planet has the right to enter the United States. He probably meant that Americans are as good as their British cousins.
Also, federal law, viz. 18 USC 3041, empowers state officials to enforce federal law at federal expense. For example, bank robbery is a federal offense, but local police don’t sit back and allow bank robbers to ply their trade with impunity. Since another federal law, 18 USC 1325, forbids your compatriots to sneak across our border, state officials are empowered to enforce that law as well.
From the Washington Times article, “Mr. Barnett’s attorney, David Hardy, had argued that illegal immigrants did not have the same rights as U.S. citizens. ” Barnett should fire his attorney. The issue is not that illegal immigrants should have fewer rights than U.S. citizens, but that they should not have more rights than U.S. citizens. If a U.S. citizen were to trespass on another’s land, federal courts would derisively dismiss any allegation that the trespasser’s civil rights were violated. Well, if the trespasser were white, they would, anyway.
The invaders, a.k.a “undocumented workers,” seem to arrogate themselves the right to sneak across our borders, the right to trespass on our land, and the right to use falsified documents. Do they think they have the right to rape our women as well? They seem to believe themselves empowered to disregard such of our laws as they please.

2) If I go onto another persons property ILLEGALLY in another country, I deserve what I get. Just because Mexico is connected physically to the United States DOES NOT give any ILLEGAL ALIEN from ANY COUNTRY (using Mexico as a conduit) the right to enter the United States. Let me make it more clear for you (you dufus).. if I enter England or Germany or Spain or Russia or Bulgaria illegally, I immediately come under their laws. Damn it! When nationalities of other nations came to America they integrated, learned English and became Americans. Poor Brewer, last week, she first she said her Dad had died in Germany fighting the Nazi in World War II (war ended 1945) and we find out her father never was in Germany and died in California in 1955 (watch the spin doctors go into overdrive) and then she went to Washington and came back empty as always, poor dear.
Comments….. Under Clinton/Gore Nafta was passed and went into effect 1/1/94. It allowed for the movement of products between Canada, the US and Mexico with far less restrictions. Under Bush/Cheney Nafta was expanded to allow for less restrictons and this included people. So it is not surprising that they did nothing to secure the southern border. They did not tell Mexico to stop training their citizens on how to get here illegaly and get an illegal  job and send the money back to Mexico. ( Stats show this is a huge income for the country) This same Bush/Cheney gave us the Homeland Security Act that allows our government to pick up anyone suspected of possibly being in any way involved in or thinking of a terrorist act. This law says that the “possible terrorist citizen” is not allowed a phone call, hearing or trial and can be held indefinately. ( Forget the Bill of Rights under this law!)  Strange that the administration felt we needed such a strong law to protect us from terrorists, even at the cost of giving up our rights,  but they left the south door WIDE OPEN and have done nothing to close it. Where exactly is the threat as they see it?  Now look at the then Pres V Fox of Mexico on CNN saying that the North American Union is comming soon and inevitable.  Look at our Pres Obama this past may at a military school graduation ceremony telling them they will serve the world and not just a soverign nation. And look at the signage for the United States Navy that now calls it “Americas Global Navy”. Are we still the United States or did we morph and nobody told the people? !!!
@benito, i only read your post at top, too many to read them all, but you are way off base about saying this nation was founded by immigrants and then claim illegals have a right to be here. We are a nation founded upon law and principle. You mentioned how the founding fathers said every man is created equal, yes this is true. However, we have had a federal laws in place regarding citizenship and immigration for a long time. Americans have civil rights. EVERYONE has human rights. That’s why the border patrol doesn’t execute everyone they see trying to cross the border. That’s why we’re required to feed them, provide shelter, give them medical attention, process them, and then we can deport them. I would like to see you cross the border into any other country. Just dont call for help when they arrest you and sentence you to 10 years hard labor or even death.
Also, aside from passing the different exams and filing paperwork, immigrants seeking citizenship have to swear an oath to this country, setting aside all allegiances to other lands.

Comments…..Why do we allow this? The biggest reason and we are really ignorant for letting it happen, the government must be getting something out of it or they do not care because the problem is not in their backyards, letting the illegals in.  If we are in such financial crisis why do we let them leach from US the LEGAL working tax payers. I hear the illegals pay taxes, if they are it DOES NOT make up for the anchor babies they have here, the food stamps, wic, etc. they get from us, long term we pay out a hell of a lot more money than they pay out.Â
OUR men are fighting a war right now, when we catch an illegal here why don’t we send them over to help fight in the war!!! Why should OUR men protect them while they are here illegally leaching from us working people and our troops families?????
The problem in our area, and not all of them………they drink, drive resulting in an accident, they own nothing, no insurance so they just walk away from the scene before the police shows up….
