Couple Forced to Destroy 40yo Pond on Their Own Property Because Govt Owns The Rainwater

Butte Falls, OR — An Oregon couple has been told they must destroy a 2-acre pond on their land — the property’s most attractive feature — because the government said so.
Although Jon and Sabrina Carey purchased the 10-acre property near Butte Falls two and a half years ago, the pond has been in place for 40 years — but that fact doesn’t matter to the Jackson County Watermaster’s Office.
“I basically bought a lemon,” said Jon, who became teary-eyed at the edge of the partially ice-covered body of water being targeted by government, in an interview with the Mail Tribune. “That’s how they explained it to me.”
But the couple desperately wants to keep the stunning longstanding feature in tact, so, as the Mail Tribune reports, the Careys have “pleaded with the Medford Water Commission to adopt the pond and treat it as a municipal water source, something Jackson County Watermaster Larry Menteer has opposed because of the precedent it would set.
“The Water Commission has rights to the watershed around the Careys’ property, where dozens, if not hundreds, of ponds are located, as well as Medford’s primary source of water, Big Butte Springs.”
And the Careys aren’t the only people in the watershed who’ve had difficulties with, well, ‘the government’s’ water.
Eagle Point resident Gary Harrington spent 90 days in jail for illegally harboring some 13 million gallons of illicit rainwater — that’s enough rain to fill around 20 Olympic-sized swimming pools.
Harrington masterfully crafted several ponds on his property — even building docks for one, and stocking it with largemouth bass — but his insistence the water would assist in fire control and prevention didn’t satisfy the government, since a “1925 state law dictates that the water belongs to the Medford Water Commission.”
As Mother Nature Network’s Matt Hickman reported in 2012,
The bigger story here is that rainwater collection is indeed kosher in Oregon, provided that you’re capturing it from an artificial, impervious surface such as a rooftop with the assistance of rainwater barrels. But an extensive reservoir set-up complete with 10- and 20-foot-tall dams is verboten without the proper, state-issued water-right permits — after all, Oregon law dictates that water is a publicly owned resource — and Harrington did not possess said permits.
Harrington and the Oregon Water Resources Department waged an extended battle over the ponds, and at one point, it was ruled he would be allowed to keep everything in place — but that decision was backtracked in less than one year.
Ultimately, “Rain Man,” as he came to be called, found himself charged with nine misdemeanors, spent three months behind bars, and had to shell out $1,500 in fines — and was ordered to destroy the dams and drain all the ponds.
Harrington’s case might have been infinitely more complex than the Careys’ — considering the large volume of water and infrastructure he’d put in place — but they share the same theme of overbearing government and arguably wholly unnecessary law versus the right of people to do as they please with their property.
“When you’re honest, they take everything away from you,” said Sabrina Carey, who inspected country records — which plainly showed the pond — before they purchased the property.
Going by the book might have been the ‘fatal’ error for the couple, however, since the county didn’t take issue with the pond until Jon sought to grow legal medical cannabis on the land and had to prove there was a viable source of water for the grow operation.
According to the Watermaster’s Office, the previous owners had not received a permit for the pond, so the Careys were now in violation of Oregon regulations — and they would have to shoulder the cost of draining the water.
In an effort to prove the pond is legitimate and persuade county government to allow it to remain on the property, the couple stopped using it — even though the well on their land had run dry — and began shipping in the water for daily living and gardening from nearly Butte Falls.
They’ve also had no choice but to hire attorney Sarah Liljefelt, who filed a request with Jackson County to provide a permit for them to store water, stating, “The reservoir on Ms. Carey’s property, though small, is one of the largest in the area.”
As the Mail Tribune notes, “Liljefelt said the pond is an important source of water for beavers, otters, elk, deer, bear, mountain lion, bobcat, bald eagle osprey, great blue heron, snowy egret, Canada geese and the western pond turtle.”
By all appearances, the large pool of water does more good for the environment than if it weren’t there at all — during their fight with the State, the Careys even suggested it be used for fire control and prevention, like Harrington did, as the pond is easily accessible by fire crews.
But the county has displayed only nonsensical obstinance on the issue.
“This pond seems to be doing way more public good than not being here. Why, now, is it so important to be removed?” Jon lamented.
Indeed, the 40-year-old man doesn’t even profit from the medical cannabis grown on the land he and his wife own, as he literally gives the crop — free of charge — to friends.
“I don’t make anything out of this,” he said.
Members of the Water Commission disagree on whether this is an issue worth fighting over at all, but as the Mail Tribune reports,
Water Commission staff found several problems with the Careys’ request, including setting a precedent that could prompt similar requests and weaken state statutes while not meeting the definition of ‘municipal water source.’ The staff found it would be very difficult to access the water stored in the pond for municipal reasons, and further monitoring and following up on compliance issues would be difficult and costly for the commission.
However, the commission also failed to state why this should be a matter for the government in the first place — why punitive bureaucracy needs to meddle with a pond on private property, serving as a valuable ecosystem, that poses no threat to anyone or anything, and isn’t even an eyesore, must be destroyed.
Besides a trailer home and dilapidated house, the pond is the only thing of value on their acreage, and, obviously, as Sabrina said, “We didn’t buy it for the double-wide.”
She told the Mail Tribune the pond should have been registered with the Oregon Water Resources Department nine years ago, but the owners at that time did not reside on the property and didn’t do so.
They have even offered to reduce the pond’s size, allow officials to inspect it when necessary, and have provided a draft easement to the commission in hopes of allowing the prized water feature to remain intact — thus far to no avail.
“We’re just trying to do it by the rules,” Sabrina explained. “I’m trying to cooperate.”
In 2012, Gary Harrington had already been through years of conflict with government officials over illicit water — and provided CNSNews with stronger sentiment on the topic:
When something is wrong, you just, as an American citizen, you have to put your foot down and say, ‘This is wrong; you just can’t take away anymore of my rights and from here on in, I’m going to fight it.’
That government feels entitled to not only something located on private property, but that people should not be allowed to collect rain, is everything wrong with excessive government — and the overregulation of daily life.

Depending upon the circumstances of the purchase agreement, closing, and the Title report, the buyer may have recourse against the Realtor and/or Title company; or even the seller.
1925 ??? That’s almost 100 years ago. A ten acre property would likely have a rural zoning classification indicating its classified for animal usage.
Removing the pond would negate the animal’s right to surface water which they would naturally consume, and thus life.
Surely there’s an animal rights lawyer out there in Liberal Land somewhere. 🙂

Back in the 80’s a young hippy couple that I went to high school with , bought a 200acre+\- farm just outside of the town we grew up in.
They had owned the farm for maybe a year when the local conservation officer approached them about declaring an old strip pit on their property a “wetland”
He sold them on the idea by conjuring up visions of otters and exotic birds so they said ok.
I don’t know what it all had to do with DNR but Tim the conservation officer is the one who brokered the deal. Everybody liked Tim he was a good guy and trustworthy.
Not long after they agreed … people from various agencies would indiscriminately show up to take water samples or whatever without any prior notice.
Long story short … One day a young man showed up from one of the alphabet agencies and made a startling discovery. He had stumbled across a half dozen or so marijuana plants growing on the young hippies farm even though they were no where close to the old stripper pit.
The couple was arrested but ultimately the hippy husband confessed he was cultivating the plants and his wife had no knowledge of them…. That way their 2 year old daughter wouldn’t get put in foster care and someone would be there to look after the farm.
The ambitious young man from the Alphabet agency (I can’t remember which agency or I would say) told LE that he became lost and that’s why he was so far from the stripper pit when he made the discovery.
The hippy husband did almost a year in county jail over the incident …

We have been battling the “water belongs to everyone” people in U.P. Michigan and Federal government for 20 plus years. Using the “water belongs to everyone” banner they have changed state and federal laws and almost destroyed my cottage and my lake.
It started when the DNR bought a site on our lake “for everyone” without public hearings (they said our lake was too small to have the hearing). At that time the lake was sand bottom. Now the lake is clogged with weeds and shore line garbage that “everyone” put there and the state has no intention of removing. The lake (half mile across) has all lots deeded for 7.5 hp max boat motors. DNR says they will not enforce that restriction because the lake is “for everyone” and they can’t stop people with 100 hp motors on our lake (across in less than 30 seconds). These bigger motors are producing waves that are ripping our shoreline apart.
Then there is my septic system that got flooded by ‘controlled’ lake levels. When I inquired to contractor about replacing the flooded septic. He told me the “for everyone” laws had changed and I could not have a septic within 75 feet of water. There is only one spot on my property that meets that requirement and it is 400 feet from my house and would require a $20K system to pump there. I could not get a variance. So…a friend helped me restart the septic (yep broke a law. But I don’t have $20K laying around).
The feds and some states have been working for years to control ALL the water. in New Mexico the feds are alreading starting to control the DRY run off of arroyo’s because they SOMETIMES have water when it rains. they have been fencing off ranchers springs where there cattle have watered for years. there are many pending law suits. it is a MESS!! IF you look over the world you will see, the elites, Iluminati, NWO, ect. etc. have been and are trying to conrol the things that would ultimitely allow the controlers of those things to TOTALY control the populatio ie. WATER and FOOD. IF we cannot get this under control just like the Islam migrants, there is NO hope for a free world. the scum are closing the gap fast and i see no way around civil unrest. bleak news for 2017, but i think most of us here have seen this coming and that is why we are prepping!!

Yes, they ARE doing it to control the people by taking away our food, our means to grow it, and now the water that our gardens need. I think in the future if we still have technology and electricity the people will be just like herded sheep living in big cities and not allowed to go to the country anymore, becuz it “belongs to the animals”. I am sorry now i had one child, becuz i have a grand daughter age 21 and a great grand daughter who will now grow up in a very Orwellian controlled world and be dumbed down by school. I’m new here, but I’ve read too many stories like yours. I recall a story from “The Humanure Handbook” about a home owner who was forced to purchased a $3,000 electric incinerating toilet to satisfy the code jackboots when he couldn’t spend thousands more to hook up to the municipal sewer system. He left said toilet sitting in the garage, went ahead with a composting toilet system, and it didn’t matter. All the code worshippers wanted to see was the receipt. They didn’t even care that it was never installed.
Sooner or later, that septic system is going to fail again. When it does, don’t be surprised if the local jackboots order it filled in as an “environmental hazard” or similar nonsense. In fact, it wouldn’t surprise me if they show up much sooner, since they probably know you have a septic tank. This is all about power, and keeping you poor and dependent, after all.
I would suggest you explore composting toilet systems, including DIY sawdust bucket types, and gray water collection systems. If you decide to go that route, do so quietly and covertly. The rule of law is on life support. Trying to deal honestly with criminals in power only sets you up for victimization.
Screw the government and the septic. If/when it breaks again just install one of those biological compost toilets. You can buy them legally and they should be legal. In the meantime if can’t afford it make one yourself with buckets and sawdust and make the wood box around it. You can also get an old persons “potty” and use that. Only put sawdust in the bottom instead of water. I found a nice one in the trash. It’s in the cellar in case i need it someday. I think if you BUY the compost toilet they can’t say anything. Screw them and don’t use the septic anymore. I am in the country. I only flush when i poop., and in the summer i pee outside. I am female too. The system trained us to believe that its “wrong” to pee/poop outside. It’s natural. It’s not natural to have a stinky toilet in the house, and a lot of people have these bathrooms right next to their kitchen. Yuk.

The planet and the people existed before governments were created BY THE PEOPLE. Water, in all its forms belongs to the people first. So if there is a shortage, if water is poisoned, then it is the governmental buildings, the corporations, the businesses that must bear the weight of that shortage FIRST. One must understand that before there were governments, before there were corporations, before there was mass media, people used water in all its forms.
Governments, corporations, etc were all created by people – starting out small and growing, some way beyond the limits placed upon them by the contract, in writing, that they operate under. Water, land, air, gardens, hunting, fishing, etc are all natural rights of the people and in the USA the government was created to PROTECT the rights of the people. That can be found in writing, in the contract that all who serve within our governments are under.

Suspicious fumes at Florida home leads to FBI-assisted probe

The Federal Bureau of Investigation said Thursday it’s assisting a Tampa Bay area law enforcement agency in the potential terrorism activity of a 21-year-old man who was arrested after his father was taken to a hospital due to suspicious fumes in the family home.
Pasco County Sheriff Chris Nocco said during a news conference there is no indication that Sherif Elganainy has terrorist ties. But he said that after chemicals were found in Elganainy’s home and that he tried to wrestle a gun away from a deputy, all leads are being pursued. Two deputies received minor injuries when attempting to subdue Elganainy.
“This is an extremely dangerous individual,” Nocco said. “This person had the potential to do bad things.”
The incident began at the family’s home in New Port Richey, a suburb some 30 miles north of downtown Tampa.

Most title insurance polices will exclude claims for non-permitted uses, just like boundary issues. All it insures is that the person who sold you the property was the actual owner and that the deed covers most of the ground in question.

4 man made small ponds, 35 acres of water on our property that backs up off a 200 acre lake and 25 acres of beaver dam water. We love all of it, and agreed to all but the beavers, they didn’t ask but are welcome.

Actually they missed the most important part of all. It’s wetlands for 40 years and federal law prohibits the destruction of wetlands, period. Unless of course you build more wetlands i.e. move a pond not just drain it. federal law should be used to shut Medford City up.
In the Southwest, any area that is covered in water for more than 7 consecutive days in a year is considered a wetland, EPA rule of thumb+-. I heard of an oil company getting slammed by the EPA over this. They drilled some wells on some dry as a bone flat land. Some areas of the lease, which was owned by the state, would flood during the monsoon season. 3 or 4 inches worth of flooding. Some of their well site pads and roads encroached on these “wetlands”.
It seems that I have heard of people who have built small dams etc… on their property and were told they cannot remove them due to the area now being a wetland. 10+ years back some fellow got crossways with the EPA over removing a pond and ended up going to jail because he messed up a wetland. Water rights are rather touchy things, current laws involved a good deal of serious conflict, including violent conflict, to end up where they are today.

They should sue their realtor. I know it’s hard for some of y’all east of the Mississippi to understand, but water rights generally work on a prior allocation basis (as opposed to riparian) in western states. Geography is different out here…
And to follow up with Sean, “Riparian rights” are the rights you have if your property includes wetlands or a lake river beach areas, or bodies of water, etc. The property I own here, I own out to the Middle of the lake and the other guy on the other side owns out to the middle of the lake on his side. It is all surveyed and marked on the certified Survey Map. So I’m considered to have riparian rights to the lake water since it is my property.
When I was in Tampa, I caught some Bayshore Millionaire cutting down mangroves across the street by the Bay, so he could improve his view of the bay from his house on the other side of the road. I called the Cops, and they were dumb as fuck then they showed up. I then filed a complaint to the county EPA for mangrove cutting. Well these people had no Riparian Rights to cut the mangroves down because the mangroves were not on their property but across the road. They got their hands slapped, as well as the parks director who somehow have them permission to cut mangroves on the City property. It was all fraud. Plus it is highly illegal to cut mangroves down, because they are the protective barrier from erosion from the bay waves etc and a massive ecological eco system where many fish spawn, oysters bed, etc. The Land owner was just a POS trying to create a view he was not entitled to.
Get involved people and do the research and know the laws and rules. Call out those destroying nature and the environment. Also note most of these people in charge of running your local County EPA, are employee SHILLS, and moved into these positions to protect their Fascist Corporations destroying your local environment. The lower echelon people are mostly good people but under the thumb of their shill director so they can only do so much, and most just want to dismiss you, cause they are lazy. So be persistent.
So when a problem arises, start collecting names of who you talk to, and file FOIA requests and call out all their fraud. I have gone through a lot of this, in the last decade fighting Fraud and environment destruction and EPA violations. When someone tells you NO, then go up the chain, to their boss, and the next boss, then the State, then the Feds, etc, and keep asking questions. Request investigations to be initiated through filed complaints. Hold their feet to the fire. Go investigate the Guy running the County Board, and see how many retention ponds he has on his property, but you can’t on your property? BS. Call out all the BS and inconsistencies on the record. Send your complaints certified mail and keep a log and record of every call, the time and date, who said what, for your records.
And demand they put their response in writing and mail it to you. Sometimes when you file a written complaint, they will call you on the phone, and give you some BS response, and you need to request they put their responses in writing on the record. They will change their tune. A phone call they can just deny they didn’t say that. Then it just your word against theirs. But in writing, it is a written document, and you can nail them more, if they try to BS you like in a phone call to appease you, then they claim you agreed and they closed the case.

One of the biggest scams out there is when a City says, Well we need to develop a feasibility study. Then spend $100,000 to some consulting company their buddy owns to create some phony document. Study the document, and the requirements and criteria under the law to create a legitimate study document. Then call out the Study’s Fraud on the record at a public meeting. And cover your ass, in every complaint letter, always include the following phrase at the end of the document.

One state I’m very familiar with, Washington, by law owns all surface and under-ground fresh water and you have to get permission to use it. I’m pretty sure Oregon is the same way. Generally you can’t screw with surface water flows without state permission. Even in Hawaii if I want to put in a pond or make a lake with a dam fed by surface or well water collection, it has to be permitted. Those laws have been around forever.
What is scary is when the Federal EPA starts thinking THEY own all the surface water and determine what wetlands are. They make political and not science based decisions.
As for building roof catchment, most states(but not all) regulate that as a health issue and not as a surface water issue. The idea being as long as I catch the water before it physically hits the ground, it belongs to me, and I can use it as I choose, as is the case in Hawaii and in most states.
If you have a permitted well here in Washington, you can use it to fill a pond. Can’t divert a stream into it, or dam it up, without a permit, but you can build your own pond separately from the natural water courses.
You can even link it up, once you get a permit, but then it’s part of the natural system and you can’t change it later.
Like I said just get a permit. Can’t get a permit? Shoot, shovel, and shut up.

David Legates of the University of Delaware College of Earth, Ocean, & Environment, who is skeptical of climate change predictions of catastrophe, realized years ago that his independent position means that he should not accept corporate money for research or speaking fees. “There’s a lot more money to be made by saying the world is coming to an end than to say that this is a bunch of hooey.”
Professor Emeritus Friedrich Karl Ewert a geologist from Paderborn University noted the “evaluation of long-term temperature readings . . . disprove that we have man-made global warming,” and presented the results of his analysis at a CFACT meeting in 2011 that of over 1,100 temperature curves from around the world, concluding, “the final result is that in 74% of all stations of the world we had no warming.” While the UN has often been told there will be terrible consequences if the CO2 concentration in the atmosphere remains at or increases from the current 390 parts per million (ppm), Dr. Ewert pointed out that “in the geological past, we had the greatest glaciation of the earth (the glacier went down to 35 degrees north) when we have carbon dioxide content of the atmosphere of 1400 [ppm]. That means it was several times higher than today.” In other words, the historical evidence proves CO2 does not control earth’s climate. Dr. Ewert summarizes “It is necessary to conclude that the particular effect of manmade carbon dioxide production is not recognizable, in other words, does not exist.”

Let’s set the story straight: I live in the area. I own property. You cannot buy a property which has water on it, and not register that water right with the Water Master and then sell it to someone else with the water rights. If they are not registered with the Water Master, they become the property of the County. The couple who are being harrassed did not do their research well enough or they would have known the sellers were not registered and the pond was illegal. Further, as this guy is growing Pot but giving it away, he is not following the rules of cultivation for marijuana in the County, and the County Supervisors take a very dim view of this. So really what they are trying to do is shut down his unlawful grow site, and the pond which is also illegal, is the means to do it.
