TSA Administrative Directive: Opt-Outters To Be Considered “Domestic Extremists”

    If the information recently acquired by Doug Hagmann of Northeast Intelligence Network is accurate, then something really big is happening in America right now – and it’s most certainly not a step towards individual liberty.

    According to Mr. Hagmann, he was contacted by a source within the DHS who provided an alarming memo detailing a new administrative directive agreed upon by DHS chief Janet Napolitano and the head of TSA John Pistole. The memo, according to Doug Hagmann, “officially addresses those who are opposed to, or engaged in the disruption of the implementation of the enhanced airport screening procedures as ‘domestic extremists’.”

    The memo leaves no doubt as to who, exactly, is leading the charge to label Americans who refuse current security measures due to health and privacy concerns as extremists. “The measures to be taken in response to the negative public backlash as detailed [in this directive], have the full support of the President,” it says.

    Under the new labeling procedures, those who choose to opt-out or are perceived as being troublemakers will be detained, questioned and processed for further investigation:

    The terminology contained within the reported memo is indeed troubling. It labels any person who interferes with TSA airport security screening procedure protocol and operations by actively objecting to the established screening process, including but not limited to the anticipated national opt-out day  as a domestic extremist. The label is then broadened to include any person, group or alternative media source that actively objects to, causes others to object to, supports  and/or elicits support for anyone who engages in such travel disruptions at U.S. airports in response to the enhanced security procedures.

    For individuals who engaged in such activity at screening points, it instructs TSA operations to obtain the identities of those individuals and other applicable information and submit the same electronically to the Homeland Environment Threat Analysis Division, the Extremism and Radicalization branch of the Office of Intelligence & Analysis (IA) division of the Department of Homeland Security.

    The United States government, under complete control and direction of our elected President, is now actively labeling anyone who exercises their 4th amendment Constitutional right which protects against warrantless and unreasonable searches and seizures as, essentially, engaging in terrorism as defined by Section 802 of the USA Patriot Act:

    Section 802 [USA Patriot Act]

    (a) DOMESTIC TERRORISM DEFINED- Section 2331 of title 18, United States Code, is amended–
    ‘(5) the term `domestic terrorism’ means activities that–
    ‘(B) appear to be intended–
    ‘(i) to intimidate or coerce a civilian population;
    ‘(ii) to influence the policy of a government by intimidation or coercion; or

    Though it may seem a broad interpretation, the definitions for domestic terrorism are very vague, allowing for a variety of views depending on who happens to be making the decisions. The very fact that TSA is allegedly going to label opt-out travelers as ‘domestic extremists’ suggest that they are, by today’s standards, considered no different than terrorists – and thus – may have their Constitutional rights stripped and be held without trial. In a previous article we discussed Matt Kernan, who may have found a Constitutional argument that works to avoid enhanced security in the airport. But, what if the-powers-that-be determined, by whatever vague definition, that the Constitution doesn’t apply?

    With the outrage from American travelers and the pressure being put on corporate profits, the President and TSA may eventually change their tune. But if they don’t, then we can expect more intrusive checkpoints from our government in the very near future. Ms. Napolitano has already publicly stated that DHS is looking at other mass transit systems like buses and trains as the next target.

    Something big is happening. And either the American people are going to force the change – starting with each individual making a personal decision to stand up against policies that can be described as nothing less than tyrannical – or the expansion of surveillance and control systems will continue to spread.

    If the American people fail this time as we did with bailouts and healthcare, the end result will be backscatter machines in schools, malls, stadiums, and any other public venue which is deemed a security threat by our government.

      20. What does not make sense is that the TSA gives you the option to “opt out”…so if I follow this correctly, even though the TSA allows us to opt out, Napolitano now says that if we opt out (follow the rules) we are extremists??

        When you go to the airport one of 3 things can happen

        A. Metal detector-pass and you’re good
        B. Selected for X-Ray- Opt in for the X-ray
        C. Opt out of X-Ray and receive a “happy ending” from the TSA

        Does that not then, make Napolitano guilty of breaking her own rules, therefore making her the “Domestic Extremist”??? She herself would be breaking standard protocol by following through with this because standard protocol is opt in…or opt out!

        Per Patriot Act Section 802, the a domestic terrorist, or one who is engaged in domestic terrorism, engage in activities that appear to or intend to intimidate or coerce a civilian population, OR, influence the policy of a government by intimidation or coercion.

        My reading of Mr. Hagmann’s memo report and the Patriot Act Section 802 suggests, to me, that both definitions, the one for “domestic extremist” and the one for “domestic terrorist” are essentially the same. The wording, of course, is not exactly the same, but by definition both can be construed as the same thing.

        Again, the language in BOTH is vague and knowing how our judges and law enforcement agencies like to make their own interpretations, the definition of domestic extremist and domestic terrorist in this instance seems to be one in the same. That’s just one man’s humble opinion, though.

        Make sure to take down names, badge numbers, and write up what happened as soon as possible thereafter, and, if the TSA screening and legal aspects of this process, entirely violating the limitation on our persons, papers, and effects being treated as chattle property by the government pursuant to the 4th Amendment has discouraged or influenced your travel choice, note your unalienable Right to Travel and Right to Freedom of Choice are both being affected.

        Once you write down everything relating to what was involved in either your treatment or decision making process that was effected by their current policy, contact competent counsel and complete the SF95 according to what you wan to do 1) civil rights claim for money damages, or 2) a writ.

        There’s an old 1971 case that may apply to this too, it’s called “a Bivens action.”  The point being let’s inundate them with claims and the potential for hundreds of millions of dollars in lawsuit pay outs and claim settlements.  And note that there may be personal liability against the individual, their retirement etc.

        Time to do more than use the vote to teach our creature in Washington a lesson 🙂

        I would ask, “If you are dead set on opting out, why are you at the airport?” I would contend that your purpose is to disrupt traffic.

        The other day on KTUU tv, there was a report that the number chosen for pat-downs was 1 in 100. A few days ago I read an online article where the odds of an individual being killed by a terrorist was roughly equivalent to being killed by an asteroid.

        Please keep in mind the nature of using statistics, but … ,

        We are spending billions on TSA to raise the odds by 1% over the risk of asteroid induced death. Might this really be about fear-reduction and increasing government jobs to present  better GDP numbers?

        Of course this site and others are monitored. I suffer no illusions about threat analysis and the government keeping tabs on me. My file began in 1969.

        I took my oath seriously then and I will never renounced it. However in order to maintain the Constitution, it might be neccessary to make some seemingly onerous decisions. After all, we are dealing with sheeple prone to panic spells. Sometimes expediency mandates that the trouble be terminated, your Constitutional rights end at the end of your nose. Encroach on someone else’s and you better expect the hammer to fall.

        That being said, too much percieved encroachment and …  well, Every government walks a fine line between management and revolution. Tipping points tend to be NOT by actions, but rather by failing to communicate the reason for the action.

        If you have a problem with lactose intolerance, why are you drinking milk? Same goes for air travel.

        Don’t think that just because you own a share of a tiger, your continued poking it in the ribs with a sharp stick will be ignored.  The nature of government is management (usually managing their way from one crisis to the next). Let your conscience (as well as your freedom and monetary assets) be your guide.

      42. The TSA was created in the last administration as part of the PATRIOT Act. Everyone but a few standouts said that the PATRIOT Act was nonsensical AND un-Constitutional.

The more extremes that the U.S. government tries to impose on common people the more it reveals it’s own growing insecurity in the world and in this country.  It’s not a popular notion to bring up with most American idiots but there is no mention whatsoever of Washington D.C. or the United States of America  in the Bible.  With that, and as far as I’m concerned, the federal governments’ eventual destiny is sealed.  The eternal reign of this so-called  SUPER-POWER does not fit into God’s final plans and it will meet it’s demise before the second coming of Christ.          

      44. My local paper quoted a TSA official stating that less than 3% of people were getting pat-downs. That includes lots of people with wheel chairs and medical devices, and people who highly value personal modesty or know enough about the dangers of radiation to avoid the scanners. Maybe that’s just <3% at the Salt Lake Airport, but that still means 4 or 5 people on your average flight get felt up.

Well if I remember my history lessons right,  Our country was founded by Domestic Extremists.  Or at least  I am sure that the king of England and his court considered them to be extremists.  Our Constitution was necessary so that things like this would not be an issue.  If we give up our constitutional rights because of the acts of terrorism that have effected our country, then the terrorists and our tyrannical government have already won.  As I have read some of the responses to this article I have heard many different opinions, many not based on any fact at all some based on fact, albeit misguided fact.  We have a Constitution for a reason, to guide this country with a fair set of rules and rights.  Our Constitution is not up for interpretation, depending on what we are trying to accomplish at the time.  The Fourth amendment rights that we have are there for OUR protection not for the government to use for there own agenda.  If we do not stand up and protect our god given rights(not our government given rights) then we will lose them to tyrants.  This is just one more assault in and on-going fight to keep what has always been ours.  With out our rights then the tyrants can do anything they want to us and we will be right back in the middle of a Monarchy as we were in the 18th century.  We need to stand up and stand up right now for what is ours if we have any chance of saving even a small part of what is left.  Remember that we have let this happen to us and we are to blame.  Wake up and smell the coffee.

Calling us domestic extremists and or any other of their labels are nothing but more of their Method of Operation.  They want to shut us up and just go along with their plans no matter what we feel or is right. Just go sit in the corner and be quiet!! I think that there are only about 8 to 10% of the population that are in on this and they are schooled and have the time to steer this crap. Soon we are going to get fed up with their shit and they will be put down in their places where they belong. The last time I checked, the majority ruled in this country. Unless the Supreme is involved. These people don’t have the nuts for a good down in the dirt fight.

        If enforcing my constitutional rights makes me an “extremist” so be it, I will be in good company.

        As to all those blaming either Republicans (President Bush) or Democrats (President Obama) I would suggest that “we” are all part of the problem.

        Proof is in one vote.  The vote in the Senate to filibuster “by not allowing a vote” on the law that would require all corporations to declare 100% of their political donations was prevented from even getting voted on by 98% of Republicans, 40% of Democrats, ??% of Libertarians, ??% of Independents.  The two Republicans that voted to hold a vote, were not up for re-election and therefore could do what they wanted and not go along with the Republican majority.

        All of the elected officials that prevented this much needed legislation from even being voted on, need to be removed from office.

        Now the Republicans control the House, will they introduce this type of legislation, no way! 

        Will the Democrats change the law in the Senate (the Republicans said they would) that would require only a 51% vote on any law for the NEXT SIX YEARS?   I hope so, but fear they will not…if not they need to be voted out of office (all political parties that vote against changing the rules back to 51%).

        Wake up Americans, if you vote for a candidate that receives large corporate campaign contributions, they are not representing you.

        This has been 30 – 60 years in the making (Citizen’s United vs FEC) and the Republicans won, read about the Two Santa Claus theory if you do not believe me.  In reality, while Republicans are worse, both parties are to blame…wake up. This was not the Supreme Court’s mandate as specified in our Constitution.

        And the Tea Party is almost 99% funded by large corporations, wake up.
         
        Thus there is only one American party today made up of Republicans, Democrats, Libertarians and the Tea Party.  This one party is completely in the pocket of corporate America.

        I am sure there are a few Independents and a few Libertarians that are not in the pocket of corporate America but I do not know who they are, do you?  (Don’t think Ron Paul complete qualifies either.)

        If you do not have three choices, you have no choice!

        We need two more viable political parties to have a choice.

      56. Vague laws create full prisons/detention centers. After reading the definitions some time ago I have made a decision to leave this country as I believe these ambiguous and vague “laws” will provide the over zealous militarized police system carte blanche. The simple truth is that we the people are the value of this country, it is our labor and energy that gives those government bonds any value, via the tax collection process. In the future anyone who disrupts this business process will be removed as not to infect others with their ideology. If you really want to know what is happening learn the economics of our system and all will become clear, follow the money and then make a decision which best suits you and your family. But dont wait–do it now!!
