The judge presiding over the Hutaree militia case has asked prosecutors to provide evidence that they were, in fact, engaged in seditious acts against the United States government and its representatives.
While we do not condone violence against the public, law enforcement or the US government, we have yet to see any clear evidence that any attacks were imminent. Most of the recorded FBI conversations suggest that it was a bunch of really fired up people talking in a group, perhaps misguided, but no actual “plan” really existed.
A federal judge on Wednesday expressed strong reservations about the weight of the evidence against nine militia members accused of plotting to wage war against the United States.
But a federal prosecutor said the government can’t always wait until a plot is carried out to charge those involved and asked the judge to consider how much better things would be if federal agents had been able to arrest Timothy McVeigh before he blew up the federal building in Oklahoma City, killing 168 people.
U.S. District Judge Victoria A. Roberts repeatedly pressed prosecutors about what evidence they are pointing to in support of the seditious conspiracy charge that all nine Hutaree militia defendants are facing.

The Hutaree members also face charges of attempted use of a weapon of mass destruction. But defense lawyers have noted no bombs were among the large amounts of weapons and ammunition seized from defendants and said the only explosives set off at Hutaree training exercises were supplied and detonated by an undercover FBI agent who infiltrated the group.
“My client has said nothing worse than you can hear on television or radio or any one of a billion Internet screeds on any given day,” argued William Swor, a Detroit attorney representing lead defendant, David Stone Sr.
