REBELLION: Second Amendment Sanctuary Cities, Counties, and STATES Spring Up Across the Country

Sanctuary cities aren’t just for immigrants anymore.

A growing number of states, counties, cities, and towns are declaring themselves “Second Amendment Sanctuaries” and are refusing to enforce gun-control laws that infringe on the Constitutional right to keep and bear arms.

While adopting ordinances and resolutions to defy gun laws isn’t a new tactic, momentum is rapidly building – likely in response to increasing calls for more gun control at state and federal levels.

Sheriffs in several states say they will NOT enforce gun control laws.

Sanctuary counties and towns are passing resolutions that state no funding will be used to enforce unconstitutional laws and that the sheriff will uphold his oath to the Constitution instead of enforcing laws that violate the Second Amendment.

County sheriffs are, legally speaking, the last line of defense in the battle for gun rights:

Federal agencies do not have state powers. Due to the Constitution’s structure of dual sovereignty, the feds have no authority to enforce state laws. Furthermore, states cannot be compelled to enforce federal laws. (source)

Here’s a rundown of the states with jurisdictions that have adopted Second Amendment Sanctuary resolutions.

Colorado

In Colorado, 23 out of 64 counties have adopted Second Amendment Sanctuary resolutions, and others are considering implementing similar resolutions. Legislators and sheriffs in the state are pushing back against House Bill 19-1177a red flag bill that will likely become law soon. Officially called Extreme Risk Protection Orders (ERPO), “red flag” laws permit police, healthcare providers, or family members to petition a state court to order the temporary removal of firearms from a person who may present a danger to others or themselves.

Weld County recently joined the growing list of counties in Colorado that have passed Second Amendment Sanctuary resolutions in response to the impending red flag law.

Commissioner Barbara Kirkmeyer, one of HB 19-1177’s harshest critics, said “The severity of this bill cannot be overstated. The name of this bill is the Extreme Risk Protection Orders. I think that’s a façade, and I think it’s fraudulent. I think actually, this bill should have been titled: ‘The Extreme Order to Confiscate Your Firearms, Eliminate Due Process, and Violate your Constitutional Rights Bill.”

Weld County Sheriff Steve Reams agrees:

“The bill is so riddled with constitutional problems that it makes it hard to understand how professional lawmakers could have constructed something so terrible,” Reams said, adding the bill, “raises some serious concerns about due process, in that a person can have their guns taken away and their rights violated, all without ever having a chance to appear in an initial court hearing and cross examine accusers and witnesses in person. In legal terms, this is an exparte hearing.” (source)

Reams added that one of the biggest problems with the law is it does not address actual mental health issues – it only allows for guns to be taken away, leaving the person in the same position and without medical help.

Illinois

To date, 63 out of 102 counties or municipalities in Illinois have adopted Second Amendment Sanctuary resolutions, and more are expected.

Maryland

To date, 3 out of 23 counties have adopted Second Amendment Sanctuary resolutions.

Nevada

Sheriffs in Nye County and Eureka County have said they oppose new gun laws in the state and will not enforce them.

Nye County Sheriff Sharon Wehrly and Sheriff Jesse Watts of Eureka County both wrote separate letters to Sisolak and Attorney General Aaron Ford expressing their opposition to the law.

“In Germany prior to WWII, we saw Hitler place restrictions on the public’s right to bear arms,” Wehrly said in his letter. “I agree with Sheriff Watts. I will not participate in the enforcement of this new law and certainly won’t stand silent.”

Watts wrote in his letter that he would not stand by while “citizens are turned into criminals due to the unconstitutional actions of misguided politicians.” (source)

Elko County may soon join Nye and Eureka – commissioners there plan to vote on a resolution to become a Second Amendment sanctuary county at a meeting on March 20.

New Mexico

When New Mexico’s new Democratic governor, Michelle Lujan Grisham, was sworn into office on January 1, Democrats in the state rushed to expand gun control. Those bills were met with opposition from most of New Mexico’s sheriffs:

Of the 33 sheriffs in the state, 29 have voiced disapproval of the package of anti-gun legislation by issuing a declaration through the state sheriffs’ association, stating that the “rush to react to the violence by proposing controls on guns is ill-conceived and is truly a distraction to the real problems proliferating violence in our counties and our state.” (source)

New York

After the NY SAFE Act was passed in 2013, some New York counties passed resolutions in opposition. There are currently 52 out of 62 counties with such resolutions, and the New York State Sheriffs Association sued to block the law.

North Carolina

Just days ago, a county in North Carolina joined the resistance:

Cherokee County passed the three-page resolution with a slim 3-2 vote, after resolution author Dan Eichenbaum told fellow commissioners that the “first thing dictators do is confiscate guns,” reported the Cherokee Scout.

Among the provisions is a warning that Cherokee County “will not authorize or appropriate government funds, resources, employees, agencies, contractors, buildings, detention centers or offices for the purpose of enforcing…laws, orders, mandates, rules or regulations that infringe on the right by the people to keep and bear arms.” (source)

Oregon

Of the 36 counties in the state, 13 have adopted Second Amendment Sanctuary resolutions, and there are surely more to come, according to a recent report by Reuters:

Organizers in Oregon plan to put even more defiant “sanctuary ordinance” measures on county ballots in 2020 that will direct their officials to resist state gun laws.

Washington

In late January, the state of Washington made the news when several sheriffs in the state publicly vowed not to enforce the new unconstitutional gun laws that were passed in November. As of February 2019, the sheriffs of more than a dozen of the state’s 39 counties have publicly stated they will not enforce the law, though some said they will only refuse to do so until the final adjudication of pending lawsuits against the legislation.

There are even 3 sanctuary STATES.

Three states have passed bills to protect 2A rights at the state level.

Alaska

In 2013, Alaska passed HB 69, which declares certain gun control measures to be unconstitutional, and made it unlawful for any state assets to go toward the enforcement of federal gun laws:

It declares that guns and ammunition possessed by Alaskans are exempt from federal gun laws. It also subjects federal agents to felony charges if they try to enforce any future federal ban on semi-automatic weapons or ammunition or enforce any new federal requirement for gun registration.

Republicans said they are willing to let the courts sort out the issues. They said that they must stand up for Second Amendment gun rights and won’t bow down to the federal government on this. A number said they heard from constituents who back the bill.

Some Democrats argued that the measure puts Alaskans at risk of criminal prosecution if they ignore federal gun laws. While the bill allows the state to defend Alaskans charged with violating a federal gun law, there’s no guarantee of that help or any sign the federal government will back off. (source)

Idaho

On March 14, 2014, Idaho Governor Butch Otter signed a bill prohibiting state enforcement of any future federal act relating to personal firearms, firearm accessories, or ammunition – effectively nullifying future federal gun laws.

Erich Pratt, Director of Communications for Gun Owners of America, cheered the governor’s action. “By signing this nullification bill into law, Idaho has joined an elite class of states that are telling the feds to ‘get lost’ — especially when it comes to unconstitutional gun control infringements.”

James Madison, the “Father of the Constitution,” also advised this very tactic.  Madison supplied the blueprint for resisting federal power in Federalist 46. He outlined several steps that states can take to effective stop “an unwarrantable measure,” or “even a warrantable measure” of the federal government. Madison called for “refusal to cooperate with officers of the Union” as a way to successfully thwart federal acts. (source)

Kansas

In 2013, Kansas Governor Sam Brownback signed Senate Bill 102, also known as the Second Amendment Protection Act, into law. Michael Boldin of the Tenth Amendment Center called the law “the most comprehensive nullification of such acts thus far”:

The new law nullifies a wide range of federal attacks on the right to keep and bear arms in the State of Kansas. It states, in part:

Any act, law, treaty, order, rule or regulation of the government of the United States which violates the second amendment to the constitution of the United States is null, void and unenforceable in the state of Kansas

In conjunction with Section 6a (quoted above), the bill defines what is meant by “the second amendment to the constitution of the United States,” and that it isn’t based off a decision of the supreme court.

The second amendment to the constitution of the United States reserves to the people, individually, the right to keep and bear arms as that right was understood at the time that Kansas was admitted to statehood in 1861, and the guaranty of that right is a matter of contract between the state and people of Kansas and the United States as of the time that the compact with the United States was agreed upon and adopted by Kansas in 1859 and the United States in 1861. (source)

      load’em into truck trailer calmly

      At this point all usually goes smoothly. The herd follows a leader. Everyone is kept calm by handelers.
      Good cowboys NEVER spook the herd. “Keep the stock calm.”

      Then transported to slaughter house. Into kill pen they follow. Calm. Then the leader is put into the kill chute. He realizes now what is happening. He bellows, snorts, grunts, fights. But it is too late. The pneumatic nail spike is driven into the dumb animals brain. Chain wrapped around legs. Carcass hoisted for further processing. Animal lifeless and dead.

      About 8 animals back every animal realizes now what is happening. They sense and smell death. They are upset and fight to escape. But it is much too late for them. They are hemmed up and controlled. Soon to be slaughtered. It is too late for them to escape the kill chute. They realised the situation way too late.

      Not out of the realm of possibility, but with counties and states in the mix, less likely. You can cordon off a city. You might possibly cordon off a county if you have a whole lot of resources. You can forget about trying that with a state.

      It’s the biggest problem with martial law; you only have so much army.

    Interestingly liberal states that voted to legalize recreational marijuana stand with the 10th Amendment but when authoritarian law runs roughshod over the Second Amendment they stand in favor.

    A 10th Amendment refresher:

    “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people”

    No where is the Federal Government authorized to criminalize marijuana.

    A 2nd Amendment refresher:

    “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

    Conversely the Federal Government is PROHIBITED from infringing on firearm ownership and carry.

    One could employ logic protecting a States citizenry possessing arms using both the Second and Tenth Amendments. The 14th Amendment ties the Bill Of Rights to the States so the Second applies to them also. The Tenth Amendment will be a future USSC case who’s outcome will be of great importance.

      The same applies to the Dept. of Education. No Constitutional authority whatsoever. Unfortunately my friend, The 10 Amendment, like most of the constitution, has been a dead letter for 50 years.

        I’m not hopeful but generally the USSC has been pretty liberal for the last 50 years and the reach of the Federal Government has increased. As Joe Louis said, “You can run but you can’t hide”. As in Heller and McDonald who’s decision was held with bated breath the USSC started reversing a trend. The Founding Fathers realized that “one size fits all” wasn’t going to be workable. If the 10th continues to be ignored while simultaneously the Federal Government increases its power grab secession is states of like mind is not beyond the scope of possibility. The incipient stages of this is an active refusal to follow the edicts of the Federal Government or at a minimal refusal of help in their enforcement (which is somewhat currently happening). The Dick Act in essence pulled the various State National Guards from State Militia status and into Reserve Army status. I suspect some push to do similar with State, County, City Law Enforcement. The alarm will ring very loud if you read/see a purge of like States National Guard leadership. Of course it would be with an ostensible excuse like “corruption”. They’ll be given rope and “allowed” to hang themself with it. Beware a Robert E Lee who states, “My heart lay with Virginia”.

        I tend to think “outside of the box” so if you read the stuff I write and you won’t sleep well at night.

          I suspect you haven’t either.
          You are, of course, right but I fear that is irrelevant.
          The National Guard as an enemy is false. It is also irrelevant.
          The problem with our NRA lead wins in SCOTUS is that they are ignored.
          To me, the danger isn’t with Federal law – it’s with society. The rise in social media has shown that (ignorant) popular pressure trumps everything. The social media environment is only going to grow in importance. We will be ostracized and THAT is huge.
          You can’t get your kids in a school because of your beliefs.
          You are fired from your job because your beliefs aren’t approved.
          Look at Zero Hedge today about the NZ government cutting off internet dissent. (Zero Hedge among others is blocked).

          ps. The purge has been going on for some time now. It is a “soft” purge – but a purge none the less.
          I know of what I speak first hand.
          Do not rely of any military rescue so to speak.

                Watch the various State Legislatures. I damn sure bet TPTB are watching them they’re being monitored (spied on) 24/7 + as are the high ranking officers in the various National Guard Units / Police in these rural, potentially “renegade” States. Watch the news for unusually events like their arrests out of no where for ostensible reasons. Before an earth quake there are tremors.

            Just wait till the ‘hard purge’ happens. I’m convinced that the Marxists plan on a hard purge. That’s why we need a ‘Hard Brexit’ of secessions. Say what everyone will, but in the end, after a lot of political misery and waste of human lives, secessions will be the only solution. Better to do it now and avoid the miseries that are coming.

        If the 10th is dead, the Constitution is dead, and there is NO LAWFUL AUTHORITY FOR THE EXISTENCE OF “GOVERNMENT”.
        If the 10th is dead, and the Constitution is dead, the WE THE PEOPLE are being “governed” by “force of arms”, alone, and the “government” is UNLAWFUL.

      Easy bro. Idaho is progressively pro 2a. Nevada is ruled completely by two counties that may as well be California, Clarke and Washoe. The rest of Nevada is very conservative or libertarian and don’t subscribe to the liberal agenda. Don’t throw the baby out with the bath water.         It’s much simpler than that. Google “Fully Informed Jury” movement. You will learn the rights that Americans have in a trial setting. One of several rights is what is called “Jury nullification”…the right of jurors to overturn laws that they consider illegal or ones being applied inappropriately. Said to be the citizen’s last barrier to an tyrannical government, the law gives the citizens the right to throw out laws such as violate the 2nd Amendment. Look it up first and then spread the information.

      Considering that the 2nd is part of the Constitution, the States CANNOT use the 10th as an excuse for UNLAWFUL legislation concerning “arms”.
      Considering that NO WHERE, in the text of the 2nd, will you find the words, “until”, “unless”, or “except”, any, AND ALL, ‘gun-control’ legislation is in violation of the Constitution and is, therefore BY LAW, no “law” and need not be obeyed …. at least according to the supreme court.
      Considering that the Constitution is the SOLE AUTHORITY for the existence of this Republic, any act against the Constitution is an Act of War against the Constitution, and thus, an Act of War against the Republic.
      Considering that anyone SWORN TO UPHOLD THE CONSTITUTION, who acts against the Constitution, is guilty of TREASON – by definition & BY LAW – and are liable to Death as the penalty

  14. these legislators who vote in these unconstitutional laws must be tried convicted and jailed for breech of duty.
    They are gonna get some police/judges killed trying to enforce these unconstitutional laws.
    Govt is same as a common burglar, robber, thief when they take life, liberty, or property without due process.
    The law allows shooting burglars, robbers and thiefs and politicians are no different.

    I thank God that I live in one of those counties. LaSalle. I’m proud of the Men and Women that voted last Nov. to become a Sanctuary county. If they come to my neck of the woods to take away our guns they will meet some of the best people in America, and they will get a fight that they will never forget.
    Like many here I took an oath “I do solemnly swear to support and defend the Constitution of the United States against all enemies foreign an domestic, that I will bear true faith and allegiance to the same, and I will obey the orders of the President of the United States and the orders of Officers appointed over me, SO HELP ME GOD.”

    There is no such thing as “Second Amendment Sanctuary”. There are simply places that obey the constitution and uphold their duty by not enacting unconstitutional, thus invalid, laws and those who don’t.

    Calling it a “sanctuary” location implies the Constitution does not provide any actual guidance, laws, rights, and binding limits on government and/or people.

    West Virginia, my home state. West Virginia gun laws are some of the least restrictive in the country. We even have legal concealed carry with no permit. No love for WV? I’ve always heard Maryland is one of the worst and it made the list. What’s up with that? The Goobermint would have one hell of a time confiscating in my hood. Lots of like minded around here.

I believe the article was specifically about municipalities, counties and states that have passed legislation declaring unconstitutional federal laws null and void rather than showing “love” for a particular state based on that state’s general climate regarding the 2nd amendment. I’m unaware of WV having passed any legislation declaring itself a sanctuary state thus far. Ditto for any counties in the state. Yes, Maryland in general is one of the worst when it comes to gun rights. That is probably why three of the state’s more conservative counties felt the need to make such a declaration. Same definitely goes for both Colorado and Illinois among others. Liberals in power but many conservatives out in the rural areas. Wv doesn’t have that problem, which is probably why it hasn’t yet felt the need to pass similar legislation. Montani Semper Liberi!

      The whole love for WV, and my “hood” was my weak attempt at humor. I guess I just felt WV deserved honorable mention for the recent permitless concealed carry law. I realize that there are other states with the same, but I think WV is the most recent. That is how they answered the call for more control. If any law will protect the rights of gun owners this is it. It will be hard to confiscate what they don’t know about. My father is Lifetime N.R.A. in Va. and cwp holder. He used to bug me about getting mine. My response was,”I don’t want my name on that list or any other”. Now I can pack with no worries. I hate to think it, but if they start confiscating in Va., I bet they go to his house first. You should hear the neighbors in WV. when they break out the full autos. Talk about a sanctuary.
