RECALL: Montanans Organize to Remove Senators Who Voted For Traitorous Detainment Bill

Americans were outraged after our elected representatives in Congress moved forward with over a trillion dollars in emergency bailout funds for banks, investment firms and failing corporations in the midst of the 2008 financial crisis. After tens of thousands of phone calls to the Congressional switchboard, overwhelmingly against the bailout funds, the American public was largely ignored by the majority of their elected representatives, who would eventually saddle taxpayers with a long-term debt in excess of $20 trillion.

In March of 2009, the American public resoundingly rejected the Patient Protection and Affordable Care Act (a.k.a. Obama Care) after it was made known that the bill would mandate, by force if necessary, that every citizen would be required to acquire health insurance. Not only did Congress and the President pass legislation that would, in a supposedly free country, require every American to forcefully pay for a service they may not want, but the more than 1000 page bill was written, introduced and approved before any Senator or Representative had a chance to read it, with Speaker of the House Nancy Pelosi famously saying:

“You have to pass the bill before you can find out what is in it…”

While those laws may be shamelessly contradictory to the fundamental Constitutional law of the land, and as outrageous as it was for Congressional representatives to ignore the American public’s calls to reject the bills, none of those come even remotely close to the most recent transgressions against the people with the passage of the National Defense Authorization Act.

As Americans enjoyed themselves with the holiday shopping season, Congress and the Executive branch worked tirelessly to destroy the 4th and 6th Amendments of the US Constitution, which protect an individual’s natural right “to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures” and ensure due process with evidence, witnesses, and public trial. The passage of the NDAA has prompted Senator Rand Paul to warn Americans that they could be considered terrorists for seemingly innocent activity and an an op-ed in the New York Times titled Guantanamo Forever? by U.S. Marine generals Charles Krulak and Joseph Hoar argued that the new legislation would essentially nullify aspects of the Constitution, saying “due process would be a thing of the past.”

One thing is clear with the passage of this legislation, and that is those Senators and Congressman who voted for its passage are violating their oaths to support and protect the Constitution of the United States, because everything in the bill is counter to the principles outlined in our founding document. As such, concerned citizens around the country are now actively pursuing grass roots efforts to utilize a never-before enacted power of the people: the recall.

Via The Daily Kos and Sherri Questioning All:

Moving quickly on Christmas Day after the US Senate voted 86 – 14 to pass the National Defense Authorization Act of 2011 (NDAA) which allows for the indefinite military detention of American citizens without charge or trial, Montanans have announced the launch of recall campaigns against Senators Max Baucus and Jonathan Tester, who voted for the bill.

Montana is one of nine states with provisions that say that the right of recall extends to recalling members of its federal congressional delegation, pursuant to Montana Code 2-16-603, on the grounds of physical or mental lack of fitness, incompetence, violation of oath of office, official misconduct, or conviction of certain felony offenses.

Section 2 of Montana Code 2-16-603 reads:

“(2) A public officer holding an elective office may be recalled by the qualified electors entitled to vote for the elective officer’s successor.”

While the Montana Constitution (and those of other states) allows for a recall to take place, there is some question about whether these powers, which are technically undefined by the US Constitution, can be used to remove acting Congressional representatives:

The website Ballotpedia.org cites eight other states which allow for the recall of elected federal officials: Arizona, Colorado, Louisiana, Michigan, Nevada, North Dakota, Oregon, and Wisconsin. New Jersey’s federal recall law was struck down when a NJ state judge ruled that “the federal Constitution does not allow states the power to recall U.S. senators,” despite the fact the Constitution explicitly allows, by not disallowing (“prohibited” in the Tenth Amendment,) the states the power to recall US senators and congressmen:

“The powers not…prohibited…are reserved to the States…or to the people.” – Tenth Amendment of the U.S. Constitution.

The issue of federal official recall has never reached the federal courts.

Nonetheless, we may soon find out, as Montana is spearheading the movement to remove both of their Senators from office, as per the petition draft that is now circulating:

“The Sixth Amendment of the U.S. Constitution guarantees all U.S citizens:

“a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed…”

The National Defense Authorization Act of 2011 (NDAA 2011) permanently abolishes the Sixth Amendment right to a jury trial, “for the duration of hostilities” in the War on Terror, which was defined by President George W. Bush as “task which does not end” to a joint session of Congress on September 20, 2001.

Those who voted Aye on December 15th, 2011, Bill of Rights Day, for NDAA 2011 have attempted to grant powers which cannot be granted, which violate both the spirit and the letter of the Constitution and the Declaration of Independence.

The Montana Recall Act stipulates that officials including US senators can only be recalled for physical or mental lack of fitness, incompetence, violation of the oath of office, official misconduct, or conviction of a felony offense. We the undersigned call for a recall election to be held for Senator Max S. Baucus [and Senator Jonathan Tester] and charge that he has violated his oath of office, to protect and defend the United States Constitution.”

While there may be eight other states whose Constitutions allow for the recall of federally elected officials, the US Constitution itself has reserved these rights for the people of each state, suggesting that such a recall movement can gain steam all over the country, and may be our last best hope of restoring Constitutional rule of law to America.

Excellent page that sums up what is and has been going on in this country for a long time. The Patriot Act I & II as well as the NDAA are simply reinforcers of the declaration of war crap.

Why remind the American people they have been royaly screwed over by a previous president when you can justify your actions through “new” legislation? By doing it the way they have, it keeps most of America ignorant and blind -never knowing we are chattel, enemies, and have been “licensed” into submission by the declaration of “emergency” that never ends.

Find me a president who is willing to declare the national “emergency” is over, and I’ll find you a candidate for assassination.

“there is some question about whether these powers, which are technically undefined by the US Constitution, can be used to remove acting Congressional representatives”

The word “ACTING” in this paragraph strikes me…
      How are they acting?
Are they acting on behalf of the American people?
      Are they acting for lobbyist?
      Are they acting at all?

There should be no benefits or pay for Congress until they live by the rules of the Constitution which they sworn to under oath, which they seem to think is just a formality and don’t take it seriously anymore.

I wish there were more ramifications for this type of “action” by Congress.

There needs to be a message sent by the American people every time Congress strips a piece of our Constitution and slowly takes away our Freedom.

More needs to be done to prevent this type of treason. Thank you Montana for standing up for our rights, I only hope others do the same. There is Power in Numbers!

You’re absolutely correct. There are many cartridges that outperform the .308 win, but I like the .308 win because the reloading components are plentiful and relatively cheap for the performance you get, and it doesn’t have the recoil of 300 win mag. The .308 win is a very good “general purpose” cartridge. It’s not great in any individual area, but it does most everything very well. Good ballistics, very good accuracy, easy recoil, very forgiving when hand loading and reloadng, very flexible with a wide range of propellants, still relatively cheap. Also, when the SHTF, 300 win mag may be harder to find than .308 unless you reload your own.

Term Limits for congress is the only answer.. Without breaking a law, how else can the people, as a whole, protect themselves from the tyranny of a “local” king or queen whose state or district repeatedly returns to power ? Only by instituting Term Limits across the board.. 2 terms and done.

Of course, those in power would never willingly limit their own power.. that can only happen when they are forced to do so by a concerted popular effort.. for all the squeeling, complaining and general bitching that has and is taking place in the politic at large; I am stunned that there is not a strong, vocal and well advertized movement to force the imposition of term limits.

Without term limits, there are no limits; but only a constant pushing back and errosion of the “limits” that have traditionally existed. Little by little, inch by inch, step by step our Republic is being “eaten” by the little arrogant kings and queens in the congress..

These posts really aren’t helpful, Kevin.

Realize that there is power in numbers and the numbers are getting angry. There’s way more ticked off Americans than there are members of Congress. These actions can only help draw attention to the power grab that is going on in the US government. While this particular action may not succeed, the value of the attention it draws is immeasurable.

If you don’t want to be defeatist, then DON’T BE!!! It really IS that simple. Consider these things temporary setbacks. No one is actually defeated until they stop trying.

MY senator travels with his own personal army, use of dealy force authorized.I ran into him at a church of a religion he is not. What a fraud. When all those “town hall” meetings were going on after the health care passage, there were many reports of people getting who were vocal at those meetings getting “night time visits” from goons. Grow up, and open your eyes to the reality of our present government.

Fear is a strong word. While I know that there are clandestine powers at work, I refuse to be quiet because of those overlying threats. I fear the alternative of bowing down to the government more than I fear standing up to the government. It’s because of the intimidation that people must refuse to be quieted. Just because someone is an elected official doesn’t mean that we cannot disagree – and disagree vocally as all get out – with them.

Now is the time to turn up the volume on our complaints – not be muted by intimidation tactics.

Sovereign Immunity under the existing Law (called the Constitution for the United States of America) is the best defense against any statutory show of “authority”.

It appears the “Act” is intended to be used by the corp as “law” for those who have not established their choice through the public records.

Sign a copy of your state and the federal constitutions, write an affidavit of identity signed by two witnesses and or a Notary, outlining who you are, and file it in the public records. Get the record number and use it for ID to present to any corp officer upon any request.

This act, like all others, can not be applied where the Constitution is Law. It applies to the fictional areas of the corp. and relies on your stupidity and those who enforce it.

A US citizen may never get a trial, but they don’t get one now anyway.

Most people should be asking themselves if our current system is fixable. If a person decides it isn’t fixable or worth the energy to fix it, there really is no sense in raising hell about it. Doesn’t make sense to me to go to town hall meetings endangering yourself or loved ones if it inevitably is a waste of time and effort. They were astonished and asked what could they do. I got their emails and said that I would forward materials that would keep them informed.

Concerning BO’s rule of law, even Rachel Maddow gets into it with BO talking about prolonged detention, preventive incarceration and legal regime. The following video is an interesting liberal newscast that not only propagandizes the “illegal Bush legacy” but the potential anti-constitutional plan of BO who may want “prolonged detention” of personnel for preventive measures. This BO speech is exactly the preparatory brainwashing that AH used to justify his future legal actions that enslaved Germany. I am all for stopping terrorists. What scares me is BO who creates a “legal regime” to construct a detention network outside of the legal system. If AH wasn’t a lesson in history, the speech would be sloughed off as rhetoric. But with AH’s process of installing totalitarianism as a comparison, BO IS laying the psychological groundwork for his overthrow of the country. Wild theory, you say? Remember his “private army”? Remember the FEMA camps? Connect the dots. Private army – detention law – detention camps – installation of tyranny. Better that we are safe than sorry. Impeach now.

      • You may be arrested and indefinitely detained merely for being “suspected” of any involvement whatsoever with “terrorism” — a term that can be twisted to mean almost anything, including protesting against animal testing laboratories or chaining yourself to a tree as an environmental protester.
      • You no longer have a right to legal representation.

      • You can be held for life without ever being charged for any crime.

      • You no longer have a right to a trial by a jury of your peers.

      • You can be murdered by the government — legally! — without ever being charged with a crime.

      • The government does not have to present ANY evidence against you to take all these actions. The government merely has to assert that you are “suspected” of being involved in “terrorism.” Such suspicion, of course, could be dreamed up against anyone! Political opponents, Free Speech proponents, protesters, dissenters… anyone at all.

Merry Christmas From BO, Congress, Legalized Martial Law?
      December 14, 2011By LBG1

At the writing of this post the MSM reports the White House had signaled it won’t veto the National Defense Authorization Act which is expected to make its way out of Congress Wednesday night over to BO’s desk by Thursday.

A bill which, in the words of Congressman Ron Paul,”We have now institutionalized and codified martial law”. A bill which should be a litmus test for all presidential contenders including the President up for reelection. So far, Barack Obama plans on signing the bill into law on Thursday. Ron Paul is vehemently against the bill. Mitt Romney was caught clueless at a New Hampshire Town Hall while, to date, Newt Gingrich, has kept mum on whether he supports this travesty to civil liberties of American citizens, a bill which would allow the military to detain American citizens on American soil, the new McCarthy Era ushered in by Barack Obama as President.
Over at the ACLU website the report, White House Backs Away from Defense Bill Veto Threat.
“The president should more carefully consider the consequences of allowing this bill to become law,” Laura W. Murphy, director of the ACLU Washington Legislative Office. “If President Obama signs this bill, it will damage both his legacy and American’s reputation for upholding the rule of law. The last time Congress passed indefinite detention legislation was during the McCarthy era and President Truman had the courage to veto that bill. We hope that the president will consider the long view of history before codifying indefinite detention without charge or trial.”
The indefinite detention legislation enacted during the McCarthy Era, the Emergency Detention Act of 1950.

      The JBV Line:
In enacting Section 412, Congress forgot its own teaching from only thirty years earlier when, in 1971, it repealed the Emergency Detention Act of 1950 (a law enacted in reaction to the hysteria of the Communist scare of the infamous McCarthy era) and enacted the Non-Detention Act, prohibiting the detention of United States citizens “except pursuant to an Act of Congress.” The Emergency Detention Act (“EDA”) was modeled on the detention laws used to incarcerate people of Japanese descent during World War II and passed by Congress over President Truman’s veto. The EDA provided for administrative detentions of persons whom the Attorney General believed might commit espionage or sabotage, if the President de-clared the existence of an “internal security emergency.”
The EDA was never invoked and ultimately was repealed because it came widely to be viewed as dangerous to civil liberties. Truman, in unsuccessfully attempting to veto it, had noted that it “would make a mockery of our Bill of Rights [and] would actually weaken our internal security measures.”
[Ron Paul,"Everybody in this country is a potential terrorist"]
Against the about-to-be-signed-by-Obama National Defense Authorization Act, Republican presidential contender Congressman Ron Paul (TX) who appeared Wednesday at Joey’s Diner in Amherst, New Hampshire.
Ron Paul: “This last week the US Congress passed a bill which repeals Posse Comitatus which means we have now institutionalized and codified martial law. Right now the battle against terrorism involves all of us. Everybody in this country is a potential terrorist and the words they use in there to bring everybody in as a potential terrorist is any associated forces, which means if you happen to visit a website, happen to attend a meeting, happen to do one association you can be accused of being a terrorist and the bill says you have no right to a lawyer. They’ve been abusive of this for many years but now it’s been codified. And this president, about a year ago, announced that some of these bad people, even though they’re American citizens, don’t deserve even charges, that they can now be assassinated. We should be consciously aware of terrorism and deal with it but to say that we’re at war with the world and we can send a drone missile and send our troops anyplace that we want is very, very dangerous. Endless wars, attacking civil liberties, this Patriot Act is not very patriotic. Let me tell you, it’s an invasion of your privacy and I’ve been wondering, how many members of Congress would have voted for the Patriot Act if it would have been called the Repeal of the Fourth Amendment Act? Big government is alive and well but the grassroots are waking up.”
[Romney, Caught Clueless in New Hampshire]
On December 11, at Town Hall meeting in Hudson, New Hampshire, Mitt Romney, when questioned about the National Defense Authorization Act, seemed caught off guard and clueless.
Voter: “I’m concerned about the loss of freedoms in name of the so-called war on terror. In light of that, I thought you were going to speak to it, it was an amendment to a defense authorization bill last week that would allow the detention of Americans arrested in the United States and to allow the military to hold them indefinitely without charging them or trying them which I think is pretty dangerous and I’m wondering what you think of that?”
Romney: “Let me look at the particular authorization, ah, and, and, and I’ll make sure on our website we’ll describe our reaction to that particular amendment. I can tell you this, which is that there is an effort on the part of violent, radical jihadis to destroy America. They’re at war, they declared war against us and whether we like it or not, we are in wartime with that entity. The radical, violent jihadist, al Qaeda and their affiliates around the world are attacking us and will attack us and will use weapons of mass destruction if someday they get them. And so, in my view, we have to recognize that in our effort to pursue that conflict that the provisions that were associated with war are provisions we may need to protect ourself. At the same time we have very great need not to infringe upon the rights of our citizens and so it’s going to take a person of sobriety and stability and judgment and capacity to make sure that we not abuse the war time provisions in a way that would harm the rights of our citizens.”
To date, Newt Gingrich has yet to make any statements about the National Defense Authorization Act.

This will open the eyes of many as this is passed on and on and on.

It’s been a busy news day. Here’s the Top Stories…

Our Fearless Leader wants to raise the debt limit, again! The Bomster says he’ll ask congress for another 1.2 Trillion, bringing the ‘official’ national debt(that’s the small portion that they actually keep on the books) to 16.4 Trillion. WOW! That’s more spending than three ex-wives with still-activated credit cards on a wine-jacked super day at the mall!
They call it the ‘debt ceiling’ but it might be more appropriate to call it the ‘debt sky’ or maybe the ‘debt stratosphere.’ (the debt from outer space? the debt that wouldn’t die? bride of debt? abbott & costello meet the debt?)

Speaking of outer space: Nasa has a new toy. It’s a big harpoon that they’ll shoot into the surface of asteroids that aren’t safe to land a craft on. It takes soil, rock, or chemical samples, then they reel it back in. Sounds promising, but it’s so expensive to operate that NASA has decided to open competitive bidding for corporate naming rights to the harpoon. Tang breakfast drink has been disqualified as a bidder, by the way.

China has unveiled a new super fast passenger train. It goes 500 kilometers per hour. That’s about 325 mph for you non-Canadians. The best part is, you can order fast food while on the train! Just slide the window down, yell your order as you pass Guang Jiu, throw your money in the second window at Beijing, and grab your sack in Shanghai! (dang, they forgot my ketchup. conductor, can you back up?) Plus, imagine hearing “You want fries with that?” with the doppler effect. Awesome!

Environmentalists are up in arms. It seems that several American cities are letting untreated sewage overflow into bays, lakes and rivers. I called a friend who lives in DC and asked if it was a problem there. He just sniffed and said ‘Nope. It smells like it always does here.”

This could be bigger than the new ipad. Several drug companies are testing a new super-strength pain killer. It’s pure hydrocodone. Said to be 10 times more powerful than Vicodin. No FDA approval yet, but customers are getting anxious. The drug isn’t even on the market yet, and already there’s 600 actors and professional athletes lined up outside the pharmacies in Hollywood!

Sinead O’Conner is getting divorced after just 18 DAYS of marital bliss. The buzz haired singer and her mate (name is unimportant, he will forever be known as Mr Sinead O’Conner) got married in a pink Cadillac at a drive up window (really) in Las Vegas. She says they have parted as friends and her only real worry is that she may be setting a bad example for the younger Kardashian girls. (ahh, the memories. remember our 1st week anniversary? and the 2nd week? if only we could’ve made it last a lifetime. on second thought, if we were cicadas, that WAS a lifetime)

Following what can only be described as ‘sexual assault’ by the Egyptian military, a court has ruled out any further “virginity tests” for women. I didn’t even know stuff like that really happened. And there is nothing funny about what was done to some of the women protesters there recently. I do find it odd though, that Lady Gaga AND Miley Cyrus have both just canceled tour dates in the middle east. coincidence? maybe not.

And finally- recently declassified information has revealed details of the ‘Hexagon’ spy satellite program from the 1970s and 80s. This secret operation sent high resolution cameras and LOTS of film into space, supposedly to peek at the Russians and Chinese. Long before google earth was ever concieved, military and cia snoops were taking high def pictures that could even show your house and swimming pool! Of the 60 miles of film developed, about half has been released to the public. Interestingly enough, almost all of it shows the back yard pool parties at Hugh Hefner’s place. By the way, Barbi Benton looks great in half a bikini!

Read close and think hmmm did I read paragraph 1?

        (1) UNITED STATES CITIZENS- The requirement to detain a person in military custody under this section does not extend to citizens of the United States.

        Hmmm or did it mean,

        (1) IN GENERAL- Except as provided in paragraph (4), the Armed Forces of the United States shall hold a person described in paragraph (2) who is captured in the course of hostilities authorized by the Authorization for Use of Military Force (Public Law 107-40) in military custody pending disposition under the law of war.

With elections 10+ months away try recalling the senator not up for election and working to outright defeat the senator that is up for election. Recalls aren’t easy, but no state should have more than one senator they have to recall.

http://12160.info/profiles/blogs/iowa-gop-moving-vote-count-to-undisclosed-location-to-prevent-a?xg_source=activity I laughed for ten minutes with this one. Why are the republicans doing this?. WHO COUNTS THE VOTES? THEY DO!(now in a secret location, for our own good of coarse!) Everyone who attends a cauccas in iowa needs to FILM the hand voting, and catch the results and name of location on film, so the fraud can be exposed viral on the net! I need sheep to wake up! The parties are corrupt to the core! Who counts the votes? Who counts the votes? Come on sheeple, ask yourself that 10 times. My favorite one(well in the top 10) is when someone “found” 20,000 votes in the trunk of a car in MN during that al frankin fiasco!! hahahahahahah!

Here in Connecticut I sent a polite email to Sen. Lieberman who voted for it(no surprise). He sent back a form letter more or less lying and saying that none of that is true and no one can detain US citizens and we gotta fight the terrorists…they really think we’re stupid.

I would sure hope that the recall goes through, but judges as they are, are under the control of those higher up and a judge is about as slimy as a lawyer, so even if the recall goes through I bet a judge out there will be paid off to cancel the recall. this system is so bad that we should all cancel our membership in it, the USA, and start a brand new country!

Google-undisclosed tabulation location. They(republican party) are going to tally up the iowa vote in secret. Why not in live time on a web site, where people can see in real time, including the people at the cauccases? Everyone attending the caucases should film the voting while its happening, have audio of it also. The location must beable to be determined! After the fraud has taken place, we can post them on the net and expose the fraud.

Since day one his plan were to rewrite it . Thats what he thinks his historic calling card is. And he will get his chance. and he will do it..But his thinking is wrong. In theory it does pertain to all Americans. His mother in law makes him watch, “Roots” and then beats that rhetoric into his head. She is his most influential and dangerous adviser. Were all in so much trouble.

One can only hope that this would be the case. Basically, it is possible in theory. Whether or not it is possible in practice is another question altogether. Government is much like a large predatory animal (docile when chained and well fed but not otherwise) and it will not surrender its life without one helluva fight. It will not go gracefully, no matter how low it must stoop to survive. I guess the real question is, “Will it go at all?”.

“I still do not understand why so many conservatives voted for this? Explain please.”

June, my belief is that the conservative vs. liberal argument is basically a smoke-screen that covers the REAL issue, which is that of a ruling class vs. a ruled class. They are all members of the same club and the motto of that club is “we have power, you don’t, and we’re not ever giving it up”. Con vs. Lib is the circus element of the “bread and circuses” public distraction that rulers have used since at least the ancient Roman times. Welfare and food stamps comprise the “bread” portion.

Montanan’s need to be the BRIGHT LIGHT in our country to IGNITE the rest of our country! Our Representatives in the US House and Senate have become lifers in DC and we know that … when we give them authority to do our bidding for us. Unless Americans vote them out and start demanding that they do what they are voted in to do … it kind of behavior will continue to happen and these kinds of laws are just the beginning of the end of what is an already dismantled ‘democratic’ society. I think the great experiment is slowly but definitely coming to an end!

Let this be the high price of treason.

369 against millions of p*ssed off patriots.

369 minority tyrants who deem themselves ruling class.

369 names who voted to violate numerous amendments, Habeas Corpus, Posse Comitatus, and douse the U.S. Constitution in flames, passing the NDAA S. 1867/H.R. 1540 allowing U.S. citizens detained and disappeared by U.S. military on U.S. or foreign soil.

How can ANY law possibly un-do what the US Constitution requires? It is the essence of the US Supreme Courts’ power that a law MUST be constitutional (in agreement with the US Constitution) IF it is to be valid. This so-called law MUST be challenged in court. If the judges are anywhere near honest in their judgment, this law WILL be thrown out as it so obviously needs to be. If it is not thrown out, then the government is not of, by, or for the people and IT needs to be replaced… by ballot, if possible, and by bullet, if necessary.
