Montana Slaps Down Police State: Bans LEOs from “Receiving Military Equipment from the Pentagon”

With the mounting police state surrounding modern day America, and numerous scenarios under which martial law, FEMA camps and civil war can be unleashed upon populations who dare to resist the federal takeover of the country, there is some good news.

Perhaps the flash points in Ferguson and Baltimore has put the question in front of everyone: do we want our police and law enforcement to become militarized, and to operate with the weapons of war?

Many states are fighting back and using cutting off local laws to cut police off from federal grants and military surplus equipment – including armored vehicles, grenade launchers, night vision goggles, weaponized drones and combat-configured aircraft.

Earlier this year, New Jersey passed a law requiring express local authorization for the receipt of military equipment under the Pentagon’s 1033 surplus program.

Now Montana is going even further by banning receipt of 1033 surplus military equipment altogether. Is this a major blow to the mounting police state?

As the Tenth Amendment Center reported:

Today, a law that will heavily diminish the impact of federal programs militarizing local police in Montana went into effect.

Introduced by Rep. Nicholas Schwaderer (R-Superior), House Bill 330 (HB330) bans state or local law enforcement from receiving significant classes of military equipment from the Pentagon’s “1033 Program.” It passed by a 46-1 vote in the state Senate and by a 79-20 vote in the state House. Gov. Steve Bullock signed the bill into law in April.

Schwaderer told the Bozeman Daily Chronicle he was a surprised Bullock signed the bill. He said he feared the governor would cave in to law enforcement lobbyists who opposed the legislation and veto the bill.

I’m incredibly pleased. In the latter part of the session you see so much partisanship so it’s heartening to see that both Democrats and Republicans could get behind it. It’s no lightweight bill. It substantially changes policy in a way that strengthens the civil liberties of Montanans.

The new law prohibits state or local law enforcement agencies from receiving armored drones, weaponized, or both; aircraft that are combat configured or combat coded; grenades or similar explosives and grenade launchers; silencers; and “militarized armored vehicles” from federal military surplus programs.

Montana’s HB330 also closes loopholes that allows local departments to purchase military equipment from Homeland Security using federal grant money – a procurement option that dwarfs the monetary value of transfers under the Pentagon’s program. According to the Tenth Amendment Center, police and LEOs aren’t totally barred from purchasing, but getting money at the local level won’t come without a fight (hence a good check on the alarming militarization around us today):

[Police departments and other law enforcement agencies] could continue to purchase them, but would have to use state or local funds, and the agencies would have to give public notice within 14 days of a request for any such local purchase.
[…]

“This foundation sets a massive precedent in Montana and the country as to what kind of society we want to have,” Schwaderer said of his bill. “If you get to the point where you need a grenade launcher, we’ve got the National Guard.”

“Arming ‘peace officers’ like they’re ready to occupy an enemy city is totally contrary to the society envisioned by the Founders,” said Michael Boldin of the Tenth Amendment Center. “They’ve turned ‘protect and serve’ into ‘command and control.’”

Though it is just one battle in the larger attempt to restore liberty and restrain tyranny, it is strong legislation for state rights.

        What this means is that Patriots in Montana will not have access to comparable weapons when the UN and a Rogue Administration come to take their guns.

        As I understand it, part of the problem is, if they have it — they’ll find a reason to use it. Originally they said these items were for raids on dangerous drug lords and highly volatile situations. Then in short order, they started calling for the heavy equipment for more mundane incidents like general drug raids, warrant service and even collecting on old traffic citations.

        In other words, THE POLICE ABUSED THEIR AUTHORITY TO USE SUCH EQUIPMENT, and innocent people started getting hurt and/or killed in their own homes.

        Stun Grenades started landing in cribs with children sleeping in it, and 12 yr old girls and 86 yr old women started getting shot in their own living rooms. Family pets started getting shot more often — and often from bad information from a snitch trying to get out of his own problems.

        If you walk your dog on a leash down any street, you run the risk of helplessly watching it get shot by some ‘roided out cop with a bad attitude. We’re not safe anywhere, not even in our own beds.

        YEAH, I’d say it’s past the time we take the war toys away from the incompetents they pin badges on these days.

One thing I know for sure is that if my home gets raided like that I WILL resist. To me it’s irrelevant what leads up to it. If you force your way into my home, be prepared to die and make sure you bring a body bag FOR YOURSELF.

            “civilians” should have access to same arms and equipment as law enforcement (who these days seem to forget they are civilians too). And same small arms as military, as I’ve said before I am open to compromise by having in semi auto configuration. But these cops don’t need to be handed a bunch of full auto bang bang toys, they have proven on too many occasion their inability to resist the temptation playing with them

        taking away the ability for local police to have an armored personal carrier will only get cops killed.

        It is not like the police are getting rocket launchers, drones, or military helicopters.

        Now when some barricaded subject is holding hostages, the police will not be able to respond in a safe way.

        It will be like the 1995 LAPD bank robbery shoot out where the police had to commandeer an armored bank truck to rescue citizens and wounded officers.

        Our local police are our friends, it’s the FEDS that are the problem.

          YOU are very wrong. please look at Wake County, N. C.. 10 helicopters, rocket launchers, and the list goes on. Four pages of purchases. The last time I saw a helicopter was at a chicken fight. $92,000 helicopter, two arrested for fighting chickens and one for a couple of joints. several loads of swat in the back of trucks. They were helping Franklin county next door.

            I use to go to fights in Kentucky, and the sheriff would set up a road block on the one way road to the fights. It would succeed at scaring the shit out of anyone who was their first time (it did me) But you would pull up trying to act all innocent and hide your beer 😉 and first thing they’d tell you is “Guys the sheriff don’t mind you fightin chickens, he just don’t want you throwing out your cans and trash on the road” They were only there to keep the shit bags from throwing there beer cans all over everybody’s yards. I ain’t been in quite a few years now, I hope their still doing them there. More reason though why I believe only duly elected Law is constitutional

Most of those guys don’t have what it takes psychologically to be a soldier, yet you want to give them a soldier’s equipment and turn them loose on the public??

    While I can appreciate what Montana and the other states are trying to do, it remains to be seen if it will have any real effect. Regardless, something has to be done to stop militarization of civilian LE and let it have a more legitimate role in our society if that’s possible. They DON’T have the numbers to take on 300,000,000+ Americans and they know it. Their safest bet is to stop their war against us and join us in removing the evil corrupt system they’ve been serving, a system which is the biggest threat to all of us.

    I don’t see a problem with cops having an mrap what is the big deal it’s not like they have artillery pieces. Look they need an armored vehicle for situations. Not a fleet of mraps but one isn’t a big deal. No I’m not a cop advocate. Cops around here are corrupt to the core so I don’t trust them myself but they do have to respond to the worst calls and tools to do the job shouldn’t be denied.

      A plain MRAP is a DEFENSIVE item, while grenade launchers, armed drones and that sort of stuff is OFFENSIVE in nature.

      I personally can only justify MRAPS in large drug busts or situations where there is known to be a lot of firepower, NOT for executing a drunk driving warrant, probation violation or busting someone smoking pot. Once the cops get it, they want to use it. People get hurt when someone chases flies with a .45, or takes a grenade launcher to a simple drug bust.

      APPARENTLY, MOST COPS CAN’T TELL THE DIFFERENCE.

    Obama told us his plan in his 08 campaign. he said we need a civilian force as well equipt as our military. That plan is unfolding now as an indoctrinated police force with heavy military toys. They are doing their best to alienate the local police, this is part of the plan.

From the top down all influence for tyranny comes from New York, not from DC, because that’s where our leading Secret Societies are located, most especially the group tying us to England.     I’m a member at a local range owned by a few long-time sheriff deputies – one is currently running for sheriff. Several years ago I took a training class, and the deputies basically told us to not trust the LEOs in the town. Some were good men, but others considered themselves to be privileged over the rest of the population. They were more political in their language, but the message was clear. One specific statement I remember was when someone asked if they should voluntarily divulge they have a CC handgun if pulled over. The deputy emphatically said “No, you don’t know how the LEO views our Constitutional right to bear arms. It’s best not to say anything, but if asked directly, I would recommend you acknowledge you’re carrying.” That stuck with me. Also, at the end of the class we were told that we now have more training than many LEOs on patrol in the town. That also stuck…

Now, due to that last comment concerning whether or not to voluntarily offer to a cop that you are carrying, when in your vehicle, I most definitely recommend that you DO NOT offer that information. Due to the current atmosphere, what will most likely happen is that the cop will ask you to hand it over so that he can run a check on it. Once you hand it over, voluntarily, chances are you will not see it again. The typical response will likely be, “You can pick this up at the station later.” Good luck with that! If you really want it back at that point, you’ll have to retain a lawyer, which is what they want, because it’s most likely not worth your time and expense to do that. They have just disarmed another citizen. “Attaboy!” It is important for you to realize what the Agenda of our current government is!

      I agree and I know in my state they try to act like you are required by law to divulge that info and produce your permit (which I believe is unconstitutional) But I need to do more research and see if that is ACTUALLY written law. Because I have had situation of me and girlfriend having to sit hands on dash for 15 mins with cop with hand on weapon by the window, all while her 2 year old daughter in back in car seat. While the cop (city) checked and double checked my “permit”. All because I pulled on the road at night for about 100 ft with only her daytime running lamps on, unaware I hadn’t turned on the actual lights and taillights. I’ve also heard city police in my town over the scanner, running checks and searches on law abiding “permit” holders weapons, just because they volunteered the same info. As the climate keeps getting worse, and police keep getting worse. A cop is the VERY LAST person you want to know you are carrying a weapon. If the cop doesn’t see it, or better yet doesn’t HEAR it, well then that is all he needs to know IMO. If you hand over your gun, then you have given away any chance you have to protect yourself.

      BTW my state finally grew half a brain and passed law where you can legally carry loaded firearm in your car with no “permit”. And unfortunately I’ve had to beat into my girlfriends brain, because I got her a little old 38 to keep in glove box, and she gets very nervous when dealing with police, and I tell her over and over keep your registrations on visor, and IF you have to get in glove box, make clearly aware that you have the pistol and move slowly. Because these days there are cops that would blow her brains all over the windshield with her daughter now 6 sitting in the backseat. Sad world we live in today.

    One of the main reasons I left law enforcement after 32 years was the militarization and the violent fascist direction I saw our department and other police departments around collapsing America going. When you see officers dress up in SWAT gear and turn into complete psychopathic assholes just itching to shoot someone, when you hear already militarized boot licking police officers returning from tours in Iraq and Afghanistan talking about ”getting some trigger time”, when you find out the drunken violent video game playing young, dumb, and full of cum souless brain dead dumbed down chemically altered officers you have to work with daily are nothing but fascist boot licking mindless COWARDS, who perceive the general public as their sworn enemy, and their fascist federal government most are already working for as their savior and lord, and when you understand you are part of an organization that supports the Corporatist fascist NWO slavemasters and their collapsing fascist FEUDAL SYSTEM, that is when you know it is time to retire and get as far away as possible from all coward boot licking police in fascist collapsing America.

  18. I just read somewhere the gov is recalling all armored vehicles. After ferguson incident. I believe the gov tested the waters and found out where the older police chiefs loyalties lay.which is with the people and they dont want these items used against them. Just my 2cents.
