Disarmed: Texas Governor Rick Perry Loses Right To Carry Firearm

The right to bear arms shall not be infringed?

Recently indicted Texas Governor Rick Perry can no longer carry a concealed weapon.

A felony indictment for abuse of power will hit Texas Governor Rick Perry, an avowed gun enthusiast, where it hurts – by curtailing some of his rights to bear firearms.

Under state law, Perry, a staunch supporter of gun rights who said he shot a coyote to death with a pistol while jogging in Austin in 2010, is no longer allowed a license to carry a concealed handgun because of the indictment.

And per Federal Law, the Governor cannot receive or purchase a firearm while under indictment.

“It shall be unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person (1) is under indictment for, or has been convicted in any court of a crime punishable by imprisonment for a term exceeding one year.”

Perry is still able to own and carry a firearm on his own property (it is not clear if that includes the Governor’s mansion in Austin). Should it become necessary for the Governor to use his weapon he’ll need to take aim and shoot with care, because he can only use the ammunition he has in his possession due to federal statutes that prohibit him from acquiring more while he is under indictment.

Innocent until proven guilty? Or the other way around?

The Governor is facing up to 109 years in prison for two felony charges stemming from his refusal to fund a democrat controlled Public Integrity Unit headed by District Attorney Rosemary Lehmberg. After Lehmberg was arrested for a DUI, Perry refused to authorize funds for her unit until she resigned.

            I disagree with you on many theological points, but would like to stick to the issues and evidence and not deal in personalities.

            I think your fundamental mistake is that you do not accept the biblical evidence that the Mosaic Covenant was replaced by the New Covenant. God promised/warned the ancient Israelites of the New Covenant that would fulfill and replace the Mosaic Covenant. When the Temple veil was torn on Good Friday, all the blessings and promises continued in His Church. God did not “cast aside” His people or renege on His promises, but the Covenant did definitely change to the New. Those promises and blessings are fulfilled and will be fulfilled in His Church.

            You have mentioned “hate” several times. I think the most hateful thing one can do is to leave a man perched on the precipice of hell and tell him everything is OK. It is a true love of neighbor, a true charity, to tell a man of his predicament and to help point him in the right direction—even if that means “tough love.”

            I make no claim to having a gift for evangelizing or of having a pleasing personality, but I certainly tell the truth as best I have been taught.

      Your so right. He is not guilty until proven and convicted. Even then, the Second Amendment did not qualify a citizen by wrongdoing because it was a right.

      Remember that the Second Amendment is the right to bear arms. That Right has been infringed upon w/ much later legislation that adds in all of those additional stipulations. Regulation on top of regulation eventually nullifies these Amendments to the Constitution.

      Same thing happening to our First Amendment, our Fourth Amendment, our Fifteenth Amendment, etc

Although I’m NOT a fan of Rick Perry or any other politician, he is still a US citizen and is still entitled to the same due process of law that all the rest of us are. HE IS INNOCENT UNTIL PROVEN GUILTY IN ANY COURT OF LAW IN THIS LAND, NOT THE OTHER WAY AROUND. Without question, the charges against him are politically motivated, and I hope he will fight the charges tooth and nail and win in court. NOT BECAUSE OF WHO HE IS, BUT FOR THE GENERAL PRINCIPLE OF THIS WHOLE AFFAIR.     You’re probably not interested in used farm equipment, but you might enjoy this ad taken from Craig’s list.

    Fifty-year old manure spreader. Not sure of brand. Said to have been produced in Kenya.

    Used for a few years in Indonesia before being smuggled into the US via Hawaii.

    Of questionable pedigree.

    Does not appear to have ever been worked hard.

    Apparently, it was pampered by various owners over the years. It doesn’t work very often, but when it does it can sling manure for amazing distances. I am hoping to retire the manure spreader soon.

    I really don’t want it hanging around getting in the way. I would prefer a foreign buyer to relocate the manure spreader out of the country. I would be willing to trade it for a nicely framed copy of the United States Constitution.

    While many will agree that guns are dangerous, just like any other machine such as a car, needle or electricity, it depends on who owns the guns. A law-abiding citizen should not be demonized for simply owning a firearm for protection purposes.

    However, it appears that only white, Christian, conservative males are being hounded over gun ownership when in America a person is around 5000 times more likely to be murdered by a Marxist cop than a “tea party right wing fundamentalist.

        I have bought 2) 7.62X54R #1- Finnish and #2 – M44.
        Very cheap and great shooters.
        I don’t know if you have one, but they would be a good addition to your collection.
        The 7.62X54R hits very hard and will penetrate a lot. Just about anything. Ammo is cheap. I like the 148 Gr. This round just seems to shoot better out of these guns.

            The Finnish is the best, and a little more expensive. They seem to be the most accurate.
            The M44’s are great little carbines. The Type 53 is china’s version of the M44, not quite as good of a rifle, but it ain’t that bad. If you can try to get one with the same serial numbers.

          The Finn rifles are the most accurate, according to legend. The M44 carbine a great, handy little rifle, be warned, that short barrel and full-strength rifle cartridge means a lot of blast!

          If you can find some of the Czech training ammo that used to out there, it’s low recoil and perfectly good out to about 200 yards.

          The carbines are generally in really nice condition. If you find a nice one dated 1943, buy it. The Russians put 50,000 out for trials on the Eastern Front, before adopting it in 1944. They are a lot scarcer than the 1944 and later dates.

              I got mine at flea market for $200.00. & 60 rounds of Ammo. It is in “A” condition. At 75 yards under a 1″ group with 148 Gr. Silver tips Russian ammo. I know I stole it, but some time you just get lucky! I guess it was my turn.

                Warm congratulations on your acquisition of a proven and reliable tool of Freedom. During the scare of 2013…these rifles became very scarce to come by. I was living in Philly at the time. Would often go to gun shows in Phoenixville and the National Guard Armory shows. The only models that were available was the Russian variants and were somewhat overpriced due to the scare. So I made a visit to my pals Dave and Brandy at Treeline Sports in Norristown and they had 2 Type53’s…one had a crack stock and the other was a little rough…but to my surprise…had matching numbers..very rare in a type53. Moneys always too tight to mwntion;-) but I picked it up for a buck and a half. The bore was not shot out, the crown was perfect and the blueing was remarkably intact all the way through..the action is a little stiff as is common for the Chinese variant. I took the whole bolt down..did my CLP on all parts..drowned my bore in ammonia and it shines like a mirror…The action improved a little but still not like a Finnish, Russian or IMO the best M44 production the Polish models. Nonetheless…I love my type 53..the only made in China product I actually do love. Got my silver tips at AimSurplus.com. scoped it out…muzzle break on it.refinished the stock and a deep mahogany stain on it..found a replacement cleaning rod and sling..I absolutely highly recommend this rifle and I know you will enjoy it every time you group at 75yrds under an inch..I do!

        When Rick Perry decided to send Texas National Guard Troops to the border. It was not to prevent this illegal invasion of America…the troops are their to “deter and refer” to Border Control agents (of which 70% of them are on paid leave).             Amazing Calgagus…I too read this article just before I posted..but really tried to stay with current topic. On the topic of the illegal invasion, I would like to sight this excerpt from the very article you have read…

    2 suggestions –

    1. Gov., forget concealed carry – open carry. Hell, grab a rifle and sling it over your shoulder.

    2. Texans – “accidentally” lose some boxes of the Gov’s preferred choice of caliber on his property. I don’t see anything in the law that says he can’t “find” ammunition.

  17. It goes much deeper than this for me where I live. I was in an abusive relationship 20 years ago, and had been ARRESTED for domestic violence. Even though I called the police, I was male, and she said I hit her. No physical evidence, but I was hauled away. Charges were of course dropped when no evidence could be produced.

    Can I buy a firearm commercially? Nope. Can I own a firearm. Yup. Am I a felon. Nope. Is this fixable? Only if I seal my records. I spent the time to appeal the denial and was told the arrest and court case had never been officially “resolved”. I forget what the fancy legal term was. I guess not guilty is not good enough. Guilty even when proven innocent. – simply because of the arrest. Working as intended folks.

    So I just buy guns privately, as that is still legal – for now. Oh and I have been in possession of firearms multiple times in public, and had the cops run my name… never an issue. But they still like to check, every time, and check the breach to see if it is loaded, and ask me why I would dare carry a firearm to or from the rifle and pistol range.

    I refuse to work with the courts to seal a not guilty record to restore something that should never have been lost. The system does not work for you folks, only the corporations, that have a revolving door with fedgov.

      I feel for you it is B.S. The Illinois State Police has to arrest the male every time. That what I was told.
      Before all the B.S. on domestic violence I could talk it out with the folks and it was over. Today I have to arrest someone. The one with the least amount of marks on them (wink.) The Illinois Supreme court ordered that we have to arrest someone.
      The worst part is it is the same people over and over again. 50% of the time it is generally with different people.

      • Indeed it was. Dodging full soup cans thrown with reckless abandon. To me that is a weapon capable of blunt force trauma. All because I refused to buy her more alcohol.

        Twenty years later, married with four wonderful kids, same wife for 19 years. But I am still the bad guy. I considered sealing but that is consent in my mind.

          • She was never charged with anything, even though I had called for help. I was arrested with nothing but verbal evidence and spent six days in jail, as it was a holiday weekend.

            My due process was pleading not guilty. The DA had no evidence, since I committed no crime. I was released on my on recognizance, and told the DA could pursue charges if he/she felt it was warranted. I guess the statue of limitations does not apply for gun rights, and maybe the DA can still come and get me… What a joke.

            I suppose I could have tried to file charges, but opted to end the relationship. I left with my car and the shirt on my back, leaving behind everything else I had ever earned and achieved in my life. She got everything.

            It was the best, and hardest thing I have ever done in my life. I truly loved that woman, but she was damaged goods and to this day is unfixable.

              Townsaver, I do sympathize with your plight, but at least you came out more fortunate than a lot of other men have. Did you know the original bill for the domestic violence law was written by a feminist? If I remember correctly it was Diane Feinstein herself. That law was and still is clearly based on gender bias toward men. It’s been proven time and again that women get special treatment under that law. I’ve had some women with alcohol and drug issues in years past. I tried to help every one of them because I cared something about them, all to no avail. They all preferred their addiction over me. I haven’t even dated anyone in 10 years. There are times when being alone hurts, but I know what abusive relationships are about. I won’t go through that again.

      Townsaver, I feel for you man! A good friend of mine got in an argument with his wife and she sucker-punched him – slammed him on the head with a cast iron frying pan and knocked him out cold. He was still unconscious when the cops got there. Guess who got arrested????

      He woke up in the hospital chained to the bed. She was sooooo nice about not pressing charges, but like you, he still can never buy a gun commercially. Our criminal justice system totally sucks!!!

    The US has one of the highest rates for private gun ownership per capita in the world and climbing. The idea to allow all/you to buy guns is in the plan. Use the other side of your brain. This means we have the right amount of guns to make sure we have enough guns to kill each other off, with just the right amount of ammo. We can’t get along now- so what’s make you think we could get along in a collapse of the standing corrupted governmental system?
    The plan of the ruling elite is for us to kill each other off in a civil conflict, saves them a lot of time and hassle. Not unlike Christians/Muslims/Jews killing Christians/Muslims/Jews, pick your religion/race/war or other country. This is all a Texas gun show, Perry is part of the show and playing his role and bit part for us to get pissed and buy more guns, ammo and complain he/you has/have rights. You don’t have any government issued/constitutional declared big government rights, only the ones you were naturally given and the ones you believe in. When did you decide you needed something written by men to tell you what rights you would have or not have? The us constitution is not what you think it is, do your research.
    Perry will be well subsidized for his role, being filthy rich is better than being president of a failing corporation. Buying and stocking will make the manufactures rich while funding/buying our own demise. Wow, just like taxes. Don’t fall for it, the process of “whole brain thinking”, will serve you well, use it. I’m not saying don’t stock up, just be aware and knowledgeable how you use your stores and on who.

    Well, as the lawyers are so fond of saying, “You can indict a ham sandwich”. The implication is that PROVING one’s case is a LOT more difficult than merely charging someone with a crime.

    Laws that terminate a person’s constitutional rights BEFORE they are proved and the person convicted of a felony crime are an abomination to all freedom loving people.

    It is the essence of freedom that we have our day in a fair court where our rights are protected and not be railroaded off to some gulag or have our rights stolen by demagogues of whatever stripe.
